This Regulation concerns rural land management and rights and use of rural land in Amhara National Region. It seeks to create favourable conditions enabling the land administration system to promote long-lasting agricultural development and productivity in the regional state by causing the full implementation of the rights and obligations pertaining to the rural land holders as are stipulated under the Revised Rural Land Administration and Use Determination Proclamation. It also provides for the preservation of the soil fertility, devises a land documentation mechanism, provides special protection accorded to women, incapables and orphans, and provides with respect to investment in rural land. Rural residents engaging or wishing to engage in an agricultural activity have a right to freely acquire a land holding in the regional state. Non-commercial organizations may acquire land if this does not affect rights of farmers. Private investors who desire to engage in an agricultural business may lease land from the Government or obtain a rental agreement from private holders.The Regulation also introduces size ceilings, provides with respect to land redistribution at kebele level (also concerning irrigated land), defines ways to transfer or give in lease land, defines obligations of persons who have acquired rural land holding or the use rights (also in respect of water flows, farming, soil conservation, prevention of degradation), provides with respect to land surveys, provides for enforcement and provides for and defines responsibilities of local government in land use and rights (the Amhara National Regional State Environmental Protection, Land Administration and Use Authority’s Woreda representative and kebele and sub-kebele land administration and use committees). The Regulations also provide with respect to expropriation of public land and compensation, for public participation and the resolution of disputes. Rural land holders may be deprived of their right if they do not farm the land in accordance with this Regulation.
