This Act provides with respect to water resources management and water and sanitation in Kiambu County. It establishes two Water Service Providers and defines functions of the Department of Water and Sanitation Services. The Act furthermore concerns, among other things: water services; sustainable management of water resources; water and soil conservation; storm water management; sanitation services; and pollution control.

This Act makes provision for wayleaves in favour of the Government on private lands for purposes of carrying out of public works and for the protection of such works on any lands. The term "private land" does not include any land sold or leased under any Act dealing with Government lands. The Government shall notify in advance the owner of land, of its intention to carry any sewer, drain or pipeline into, through, over or under any private land without the consent of the owner.

This Act constitutes the Commission in accordance with the Constitution and provides for its structure, operations, administration, functions and powers. In addition to the functions set out in Article 234 of the Constitution, the Commission shall: (a) formulate policies necessary for the achievement of its mandate; (b) provide strategic direction, leadership and oversight to the secretariat; and (c) do all such other things as may be necessary for the effective, discharge of its functions and the exercise of its powers.
