Ley Nº 12.086 - Ley de adjudicación de tierras a comunidades aborígenes.

Mediante la presente Ley se autoriza al Poder Ejecutivo a restituir, bajo la forma jurídica de adjudicación que corresponda, a las Comunidades Aborígenes nucleadas por la Organización de Comunidades Aborígenes de Santa Fe (OCASTAFE) y otras comunidades de la Provincia, tierras fiscales. La adjudicación reviste el carácter de reparación histórica a favor de los pueblos originarios y preexistentes a la Nación (art 2º). Las adjudicaciones se realizarán de manera gratuita y libre de ocupantes, en forma comunitaria o individual, según el interés de cada grupo o comunidad (art. 3º).

La presente Ley tiene por objeto el tratamiento integral de la situación jurídica, económica y social, individual y colectiva de la población indígena, reconociendo y garantizando la existencia institucional de las comunidades y sus organizaciones, así como el derecho a la autodeterminación dentro del marco constitucional. El artículo 7º crea el Consejo de Desarrollo de las Comunidades Indígenas, que actuará como autoridad de aplicación de estas disposiciones.

The present Order is made under the Territorial Lands Act. The purpose of this Order is to withdraw from disposal certain tracts of territorial lands in order to facilitate the resolution of Aboriginal land and resource agreements. Section 2 deals with exceptions and section 4 concerns existing rights and interests. The text consists of 5 sections and 2 Schedules.

The present Order is made under the Territorial Lands Act. The purpose of this Order is to withdraw from disposal certain tracts of territorial lands in order to facilitate the conclusion of Aboriginal land agreements. Section 2 establishes that the tracts of territorial lands set out in Schedule 1, including the surface rights to the lands, and the tracts of territorial lands set out in Schedule 2, including the surface and subsurface rights to the lands, are withdrawn from disposal for a period of two years beginning on the day on which this Order is made.

Yale First Nation Final Agreement.

The present Agreement - made under section 35 of the Constitutino of Canada - constitutes the full and final settlement in respect of the aboriginal rights, including aboriginal title, in Canada of Yale First Nation. For the purpose of the present Agreement “section 35 Rights of Yale First Nation” means the rights, anywhere in Canada, of Yale First Nation, that are recognized and affirmed by section 35 of the Constitution Act, 1982.

The present Agreement is a political or policy document between the Government of Canada, Government of Yukon and Yukon First Nations as represented by the Council of Yukon First Nations (CYFN). This Agreement is a common template for negotiating First Nation Final Agreements. It is important to note that the Umbrella Final Agreement, on its own, is not a legally enforceable document.

This Act makes provision for the establishment of a Council of Traditional Leaders in order to advise the President on: (a) the control and utilization of communal land; and (b) all such other matters as may be referred to it by the President for advice. The Council shall be composed of representatives of Traditional Authorities, i.e. the authority of a traditional community comprising the traditional leaders of that community who have been designated and recognised as such in accordance with the provisions of the Traditional Authorities Act, 1995.
