This Order amends the Planning etc. (Scotland) Act 2006 (Saving and Transitional Provisions) Order 2011 in relation to relating to enforceability of obligations in respect of agreements entered into under section 75 of the Town and County Planning (Scotland) Act 1997, which was amended by the Planning etc. (Scotland) Act 2006.

This Ordinance empowers the Council Committee to order in writing the owner or occupier of land to undertake or adopt such measures as they may deem necessary for the conservation of natural resources on such land and the prevention of injury to the natural resources on other land. Such Order may be made for prohibiting, regulating or controlling, among other things: (a) the breaking or clearing of land for the purposes of cultivation; (b) the grazing or watering of livestock; (c) the firing, clearing or destruction of vegetation; or (d) afforestation of deforestation.

This Order amends section 1 of the Forestry Act 1967 by modifying, in accordance with section 59 of the Climate Change (Scotland) Act 2009, the functions of the Forestry Commissioners, to enable and require them to use land in Scotland placed at their disposal in the such a way as to contribute to the delivery of the climate change targets which are set in or under that Act.

Town and Country Planning (Tree Preservation)(England) Regulations 2012 (S.I. No. 605 of 2012).

These Regulations make provision regarding the making of tree preservation orders under the Town and Country Planning Act 1990, which protects trees in conservation areas. They, among other things: prescribe the form of tree preservation orders and the procedure for their making, provisional effect, confirmation, variation and revocation; set out prohibited activities in relation to a tree protected by an order; and provide exceptions.
