This Act shall apply to any agreement, regardless of its form, which is intended to give rights in personal property, including houses on land not owned individually or entirely by the party or parties purporting to give an interest in the house, as security for the performance of any obligation. Such Agreements include, among others, pledges, conditional sales agreements, chattel mortgages, and leases under which ownership of personal property is to pass upon completion of the terms of the lease.

State Committee on Land Survey is a state institution responsible for the state and elaboration of the common state policy in the sphere of land relations and carrying out land reform. State Committee on Land Survey is authorized to carry out its functions directly, through its local branches and land-surveyors of local self-government.

Certificates of land tenure shall be registered in accordance with the projects of inter-economic land survey practice (submission of land-surveying materials on concession of the plots of land for determined purposes) validated by the Government, organs of executive power in accordance with the established modalities and their filling in shall be preceded by mapping of the boundaries of land tenure that is the ground for issuing certificate of land tenure.

The following order of the formation and registration of the right of land tenure shall be applied: 1). A citizen shall submit to the district land committee an application for the allotment of a plot of land for setting up a peasant farm. 2). Examination of the application shall include the following documentation: a). map of the plot of land; b). decision on allotment; c). decision of the rural land committee on setting up peasant farm; d). certificate of the rural land committee on land share; e).

The present Law establishes legal basis for land valuation and determines complexity in the process of carrying out land valuation. The Law consists of 2 chapters that contain 12 articles. Chapter 1 (arts. 1-6) lays down general provisions. Article 1 introduces the main concepts and terms of reference. Article 2 regards land valuation. Article 3 regards determination of cadastre zone. Article 4 specifies legislation on land valuation. Article 5 regards the object of valuation. Article 6 regards licensing of activity regarding land valuation. Chapter 2 (arts.

Land in the Republic of Tajikistan is exclusive state property, and the state guarantees its efficient use in the interests of the population. One of the main ways of the agricultural development of the country is the improvement of the state of ameliorated land, organization of complete, rational and efficient use of available land and development of new lands. The Regulation consists of 18 Sections. Section 1 is a foreword. Section 2 regards land resources. Section 3 regards arable land. Section 4 regards perennial plants’ land. Section 5 regards hay-making and grazing land.

Le présent décret porte institution et organisation du programme de sécurisation des recettes domaniales, cadastrales et foncières, qui assure pour le compte du Trésor Public, le suivi, le recouvrement le contrôle des droits, redevances et taxes générés par l’activité domaniale, cadastrale et foncière.

Le présent décret définit les règles de collecte des titres de créance de l’Etat, les modalités de recouvrement et de contrôle des redevances et taxes relatives au domaine national, au domaine public et au domaine privé de l’Etat, ainsi qu’aux travaux cadastraux. Le programme de sécurisation des recettes domaniales, cadastrales et foncières assure pour le compte du Trésor Public, le suivi, le recouvrement le contrôle des droits, redevances et taxes visés à l’article 1er du présent décret.

The procedure for the implementation of the state registration of rights of possession, use, lease and ownership to the land plots, as well as servitudes and other restrictions of these rights, are stated in the present Directions. The present Directions are designed for Goskomsev land resources services of districts, as well as for Uzgeodescadastre state real estate cadastral services of districts and towns which are commissioned to implement the official registration of the rights to the land plots.

This Decree prescribes the implementation of the Land Law of 2003. It deals with the following matters: land price-determining methods, price brackets for assorted land categories; land use levy and land rent collection; compensation, support, resettlement when the State recovers land for use of defence or security purposes, for national interests, public interests, economic development; land inspection; sanctioning of administrative violations.

Transfer of land or plots of land from one category into another shall be carried out in accordance with the application by the persons concerned submitted to executive organ of state power or to organ of local self-government that are authorized to examine such applications.

The Law provides for land cadastre registration and the creation of the National Cadastre. It sets forth extensively the administrative procedures (up to the initial registrations of properties at the land logbooks) and lay down the guidelines for dispute settlements.
