El objeto de esta ponencia es analizar los aspectos socioeconómicos y jurídicos que sustentan la reforma de la Constitución por vía de referendo, que pretende prescribir el derecho fundamental al agua, e indicar que las disposiciones propuestas a la ciudadanía son acertadas para resolver sus necesidades más sentidas en esta materia.

En la investigación longitudinal transversal “cuestión agraria”, desde la crisis europea a Colombia.¿Cómo se destruyó la sociedad primitiva y surgió el esclavismo, feudalismo, y capitalismo?,incidió en los modos y medios de producción. La cultura tairona y muisca interrumpidas y explotadas;el campesino perdió tierras 90% micros fundíos, tierras fértiles 10% de terratenientes. Lascapitulaciones, cédula real, cabildos, código de indias colonial, legalizaron la propiedad, y dieronorigen al latifundio con normas jurídicas.

Desde inicios del siglo XXI, la Gestión Integrada de los Recursos Hídricos (GIRH) se ha constituido en el modelo referente de manejo del agua a nivel mundial. Organismos multilaterales, como el Banco Mundial o el Banco Interamericano de Desarrollo, y organizaciones internacionales, como la Global Water Partnership, han impulsado reformas institucionales en diversos países con el fin de instaurar un modelo de gobernanza que cristalice los principios de la GIRH.

Problems related to water resources have been the source of conflicts at different levels and between different actors. Consequently, new political-institutional schemes have been proposed, shifting towards governance, permitting the involvement of new actors in political decision-making processes. This article presents a case study on water management in the municipality of Union de Tvla in western Mexico, using the Analytical Governance Framework, which addresses five elements: problems, actors, nodal points, norms and processes.

Nesse artigo, pretendemos mostrar como um certo ideal de índio permeia as utopias indigenistas do Estado brasileiro e como a política de isolamento, influenciada por esses ideais, apresenta suas idiossincrasias e contradições. Apresentamos um estudo sobre os conflitos recentes na Terra Indígena Vale do Javari (AM) que levaram à morte violenta de índios Korubo e Matis, considerados pelo governo respectivamente como “isolados” e de “recente contato”. Analisamos a história do conflito a partir das narrativas indigenistas e dos indígenas.

En este artículo presentamos una reflexión analítica sobre los principales aspectos y oportunidades favorables que pueden surgir para mujeres de menores ingresos o comunidades marginales de Colombia a partir del pronunciamiento de la ONU A/64/L.63/Rev.1, del 26 de julio de 2010,1 que “declara el derecho al agua potable y el saneamiento como un derecho humano esencial para el pleno disfrute de la vida y de todos los derechos humanos”.

This report documents the violent clashes between members of farmer communities and members of herder communities in parts of Nigeria, particularly in the northern parts of the country, over access to resources: water, land and pasture. It also documents the failure of the Nigerian government in fulfilling its constitutional responsibility of protection of lives and property by refusing to investigate, arrest and prosecute perpetrators of attacks.

In India, the Schedule Tribes have remained on the fringes of growth, but less so in the majority tribal areas of the North East. This has increased the interest in the Sixth Schedule, the special constitutional provision relating to these areas, recognising the tribal communities’ rights of ownership and control over their land and natural resources.

Questions about land use are inextricably related to decisions about where and how to engage in extractive industry activities. Latin American countries have dealt with a range of land-related challenges, from land use planning and consent for securing access to land, to special considerations for indigenous peoples and environmental conservation, all of which have important implications for governments and local communities. This selection highlights some of the key publications dealing with issues of extractive industries and land use in Latin America

This study examines benefits of rent control law in Metro Manila. The results show that rent control benefits are conditional to occupying a rent-controlled unit and on tenure. The benefits of rent control are found positive. Many poor and low-income households are benefited but the distributional effects are minimal since non-poor families have equal access to rent-controlled units. Evidence of losses or income transfers from landlords to tenants is not substantiated. The most probable income transfers are those from short-stayers to long-stayers.

The Law and the Constitution of Pakistan under Article 23, allow the citizens of Pakistan equal rights to acquire, hold, own and dispose of property, but reserve the right to intervene in the property rights if the ownership or disposal of property clash with what is perceived to be the broader public interest. The State is also responsible for providing protection to its citizens.

The Entrepreneurial sector in South Africa is seen as a critical component in addressing the fundamental issues of unemployment and poverty, as well as contributing to meaningful Black Economic Empowerment. This is very evident with the Home Based Entrepreneurs though low rates of entrepreneurship are still occurring. This research seeks to provide a deeper understanding of housing as a productive asset and its role in promoting economic activity and improved affordable housing supply, through supporting the activities of Home Based Entrepreneurs and Small Scale Landlords.
