La presente Ley reforma integralmente la Ley de Expropiaciones, que regula la expropiación forzosa por causa de interés público legalmente comprobado. La expropiación se acuerda en ejercicio del poder de imperio de la Administración Pública y comprende cualquier forma de privación de la propiedad privada o de derechos o intereses patrimoniales legítimos, cualesquiera sean sus titulares, mediante el pago previo de una indemnización que represente el precio justo de lo expropiado.

El presente Decreto tiene por objeto establecer los mecanismos para la efectiva protección y seguridad jurídica de las tierras y territorios ocupados o poseídos ancestralmente y/o tradicionalmente por los pueblos indígenas. Con la finalidad de garantizar la seguridad jurídica sobre la información existente en el Estado colombiano en materia de propiedad colectiva indígena, el Ministerio de Agricultura y Desarrollo Rural, creará un sistema de coordinación interinstitucional para la unificación de la información predial de los territorios indígenas.

This Decree establishes that proposals for expropriation of public property and property of local government shall be accompanied by certification by State Land Service related to ownership of public land plots and cadastre registration thereof.

The Act establishes that the right to administer soil, water and air is vested in the State. The State, therefore, has the authority to: (a) regulate the allotment, use, supply and maintenance of soil, water and air; (b) regulate the legal relations between persons and soil, water and air; (c) regulate the legal relations between persons and legal acts concerning soil, water and air. The present Act declares valid the Agreement between Her Majesty the Queen in right of Canada and the Gwich’in, as represented by the Gwich’in Tribal Council, signed on 12 April 1992. Section 5 establishes that for the purposes of carrying out its objectives, the Renewable Resources Board established by the afore-mentioned Agreement has the capacity,rights, powers and privileges of a natural person. La presente Ley tiene por objeto establecer un régimen jurídico especial que permita realizar, en forma ágil y expedita, diligencias de legalización de la propiedad o de regularización de la posesión, que sean necesarias para otorgar seguridad jurídica sobre estos a personas de escasos recursos económicos y a personas afectadas por desastres naturales ocurridos a partir de enero de 2001.

The present Act provides the Government of the Northwest Territories with authority related to the disposition and use of land, including the disposition of subsurface minerals. Furthermore, it provides the Government of the North West Territories with the authority to lease and sell land, and sets out prohibitions on trespass and the unauthorized use of public lands.

The present Act lays down provisions relating to the assessment of real property for the purpose of the imposition of real property taxes.
