concession (foncière)

This Law is composed of 4 Chapters divided into 25 articles. Chapter I deals with definitions and terms and defines the steps for the concession and exploitation of State lands. Chapter II provides for the definition of private State lands, concession rights, exploitation rights, ownership transfer and land leasing. Chapter III contains offences and penalties.

This Decree-Law, composed of 39 articles, rules on State’s withdrawal from the management of production units. To this end, it stipulates that the Government shall implement development programmes, as well as define the guidelines for the zoning of the production units to be assigned.

This Law aims at regulating land survey and land registration. This Law is composed of 8 Chapters divided into 79 articles. Chapter 1 deals with Sheets and authoritative entry. Chapter 2 provides for land ownership rights. Chapter 3 refers to disposal of land rights to be recorded in the Land Register.

This Decree-Law establishes the legal regime applicable to rural public lands. It concerns the different uses (concession, lease, possession, etc.) of lands adjacent to railway lines, with a maximum surface area of 100 km, as per Decree-Law No. 1.164 of 1 April 1971.

This Act lays down the basic principles of forest management and conservation, makes provision for the administration of forestry (Chap. I), the survey and classification of lands for purposes of forestry (Chap. II), and the use of forest resources (Chap. III).Basic policy principles are outlined in section 2. Section 3 contains definitions.

Cette ordonnance établit le régime foncier et domanial en Mauritanie.La terre appartient à la nation et tout Mauritanien, sans discrimination d'aucune sorte, peut, en se conformant à la Loi, en devenir propriétaire, pour partie. L'Etat reconnait et garantit la propriété foncière privée qui doit, conformément à la Chariâa; contribuer au développement économique et social du pays.

The Law provides for mining and exploitation of mineral resources as natural gas, petroleum, crude oil and assorted minerals. Prospectors must apply for a prospecting licence that shall be granted after the payment of a fee. Lands alienated for the purpose of mining operations shall be paid off as rent and royalties. Lands comprise also the continental shelf.

Under this law a person occupying or entitled to occupy agricultural land , under a lease agreement or by authority shall not make non-conforming use of that land save under a written permit from the Minister of Agriculture (sect. 2).
