The present Law establishes the form of land ownership, the base of origin, changes and cessation of land ownership, regulates the order of realization of the rights and the duties of landowners. The land relationship connected with privatisation of buildings, structures, and constructions belonging to state property are regulated by special acts related to land legislation. Land ownership in the Republic of Belarus is present in the forms of state and private ownership.

This Act makes provision for the registration of alienators having the right to negotiate negotiation of alienation of land of custom owners and the registration of mortgages on alienated land. Furthermore the Act provides for various matters relative to negotiation of land and consequences of alienation. Notwithstanding the provisions of the Land Reform Act, Cap. 123, the Minister shall cause a register of alienators to be kept (sect. 2) and if the Minister is satisfied that an applicant under section 3 is an alienator he shall register him as such in the Register.

This Law shall determine types and organizational forms of enterprises, rules of their foundation, registration, re-organization and liquidation, and organizational mechanism to conduct their business under conditions of transition to the market economy. Natural resources shall be possessed and used on a paid basis by enterprises pursuant to the prescribed procedures and when envisaged by Ukrainian legislative acts – on privileged terms. Owners of land and land users shall annually pay fees for land in the form of a land tax or lease payment.

The President, for the purpose of regulating the purchase by natural and legal persons of the plots of land under immovable property in the rural areas, decrees as follows: 1) Natural and legal persons that own edifices, constructions or other immovable property in the rural settlements and those situated on agricultural land have the right enter in possession of the plots of land on which the aforesaid immovable property is situated either for pay or free of charge.

Deputy Premier orders to forward the Basic Regulations for registration and application by the ministries and institutions entitled to elaborate normative acts regarding mortgage. Mortgage can be applied to the plots of land, including agricultural land. Till enactment of legislative acts the Committee on Land Resources and Land Survey and its territorial branches must carry out regarding the modalities of state registration of immovable property registration of the plots of agricultural land.

Technical requirements for the plan of a plot of land.

Plan of a plot of land must be usually designed with the application of the national system of coordinates. For securing the boundaries of a plot of land on location there must be installed landmarks. Specially designed point of a boundary of a plot of land or other object. Average errors in the position of the landmarks respectively to the nearest points of state geodetic network must not exceed 0,1 mm on the map of scale of 1:2000.

The Committee, in connection with the issues arising in the process of the application of the Technical requirements for the plan of a plot of land validated by the Committee on Land Resources and Land Survey (ROSKOMZEM) 11 June 1993, clarifies that Technical requirements must be applied exclusively to sale and purchase by the citizens of the Russian nationals of the plots of land or their parts destined for personal subsidiary small-holding, gardening and individual housing.

The present Law establishes that the form of contract regarding mortgage of the plots of land, sea and river vessels, registered on the territory of the Russian Federation, irrespectively of the place of conclusion of such contracts must be regulated by the Russian Federation. Article 41 deals with mortgage of the plots of land. It establishes that mortgage of the plots of land by the persons who have the right of ownership to them if it is not covered by Section 2 of the present law must be regulated by land and other legislation of the Russian Federation.
