The present Act lays down some amendments and addenda to the Land (Group Settlement Areas) Act 1960 which provides for the setting up of group settlement areas by the State Authority and lays down related conditions of alienation and occupation with respect to both rural and urban lands. Section 16, in matter of transmission on death of rural holdings, is deleted. Sections 7, 12, 14 and 15 are amended. Lastly, the First Schedule is supplemented by inserting, after Form A, Form AA relating to the application for consent to transfer rural holding.

This Act provides with respect to perpetual succession to land. Trustees or a trustee may be appointed by any community of persons bound together by custom, religion, kinship or nationality or by any body or association of persons established for any specified purpose, or for any purpose which, in the opinion of the Minister, is for the benefit or welfare of the inhabitants of Zambia or any part thereof. Such trustees or trustee may apply to the Minister for a certificate of registration of the trustees or trustee of such community, body or association of persons as a corporate body.

The following new sections are inserted in the Land Acquisition Act, 1994: Section 5A concerns a notice to be given by the Commissioner to the Registrar-General regarding land acquired under section 5(3) of the principal Act. This Act stipulates that every person who shall unlawfully persist in wandering or remaining upon any plantation, land or premises having been warned not to come thereon or to depart therefrom and every person who enters by night any dwelling-house, or any verandah or passage attached thereto, or any yard, garden or other land adjacent to or within the curtilage of such dwelling-house without lawful excuse, shall be guilty of an offence and on conviction thereof shall be liable to a fine.

The present Act repeals Section 2 and amends Section 3 as per when it is not possible to serve the notice of eviction, this very notice may be exhibited directly on the land for all to see it and date of eviction shall not be set less than thirty days from being served or shown. The following Sections are added: Section 6A dealing with the timing for the application of eviction; Section 11A whoever re-enters in ten years time in a land from which he/her has been evicted shall be fined or jailed for the offence.

The Ordinance provides for the restitution of lands formerly owned by the State and unlawfully possessed or occupied. A notice of eviction shall be served to the persons occupying the land, complete with an eviction date by which they have to vacate the land. The evicted person may appeal against the eviction no later than six months since being served the notice itself.

The Ordinance provides for all forest and unoccupied or not cultivated lands, even lands where cinnamon is sown, to be property of the State and their arbitrary occupation unlawful. Perpetrators shall be summoned and only in the case they can demonstrate to have rights of ownership on those lands, they shall be granted their possession.

There shall continue to be a Registrar of Land who shall be the Director for the time being of Lands, Surveys and Environment. The Registrar shall maintain the Land Register whereas the Department of Lands, Surveys and the Environment shall administer this Act. When after the commencement of this Act any land becomes Public land, or freehold land, or any customary land lease is created, it shall be the duty of the Registrar to include such Public land or freehold land or upon application, such customary land lease in the Land Register.
