Upper Austria Right of Passage Law 1998.

Article 1 of the above-mentioned Law establishes that the right of passage allows persons, animals and their appurtenances to pass over somebody else’s property. The said right is granted by the Agricultural Office. The text consists of 24 articles divided into 4 Parts as follows: Rights of passage and related facilities (I); Customary right of passage (2); Authorities and proceedings (3); Penalties (4).

Geothermal Resources Act (Cap. 314A).

This Act concerns the exploration, ownership and exploitation of geothermal resources, i.e. any product derived from and produced within the earth by natural heat. All unextracted geothermal resources under or in any land, if not vested by law in any other person, shall be vested in the Government. The Minister may declare geothermal resources areas. Exploration for geothermal resources requires an authorization from the Minister whereas exploitation requires a geothermal resources licence to be issued by the Minister.

The present Decree codifies into one unified text the provisions of Royal Decree No. 19.12.1955/21.1.1956 and Legislative Decrees Nos. 3570/1956 and 3777/1957 regarding the income of local self-governments. Among other provisions, the Decree provides for the management of immovable property of local self-governments and establishes rules on licensing, leasing, rights of use and management of communal or municipal slaughterhouses (arts. 3-4), grasslands and pasture lands (arts. 5-11) and medicinal waters (art. 12).

This Act defines the right of access private islands of the Seychelles by a government officer and powers which may be exercised by Government officer. It also concerns the exercise of government functions by such officer. Any person shall have the right of access in case of an emergency to an island in private ownership. A government officer may, in exercise of his or her functions, among other things: inspect livestock and plantation on the island and fell any trees, lop branches and remove vegetation or brushwood on the island.
