This Regional Law determines composition, elaboration and modification of the regional land-use planning scheme. Land-use planning project shall include regulations on territorial planning and mapping of objects projected for location, description and characteristics of land areas and names of urban, municipal districts and inhabited areas. Monitoring of land-use planning schemes shall include state of environment and environmental protection arrangements.

This Regional Law regulates relations in the sphere of conservation, management and state protection of the objects of cultural heritage. Regional Government shall make decisions on inclusion of the objects of cultural heritage of regional significance in the state register of the objects of cultural heritage. Authorized state regional institution shall perform monitoring of objects of cultural heritage inserted in the state register.

This Regional Law establishes the modalities of conservation and protection of protected areas and defines the status thereof and the status of environmental protection institutions located on their territory, classifying protected areas as follows: (a) state nature reserves, including biosphere reserves; (b) national parks; (c) natural parks; (d) state nature reserves; (e) nature monuments; (f) ecologic-ethnic areas; (g) dendrological parks and botanical gardens; and (h) healthcare and health rehabilitation areas and spas.

This Law amends and supplements articles 81-83 and 86 of Law No. 10119 of 2009 with regard to the inspection rules and rules of procedure which should comply with law no. 10433 of 2011 on inspection. Both penalties and complimentary measures can be issued in cases of infringements. Inspection decisions may be appealed according to the law on inspection.

These Regulations amend the Planning and Development Regulations 2001 in various Regulations so as to insert Irish Water as a prescribed body for the purposes of plans and proposed development under various provisions of the Planning and Development Act, 2000.

These Regulations provide for the direct application by state authorities to An Bord Pleanála (National Planning Board) for approval for works or development where the works or development are urgently required in order to preserve, protect or improve the quality of the environment or protect human health, in compliance with EU Directives.

This Regional Law establishes the grounds for and the modalities of transfer free of charge on condition of ownership to local government of land plots pertaining to regional property. The aforesaid transfer shall be performed for municipal land-use planning and development of urban areas. Land pertaining to regional property free of third-party claims and not occupied by constructions and edifices can be transferred to local government. The aforesaid transfer shall be performed by decision in the forms of Governor’s Decree.
