El presente informe fue construido de manera conjunta por las Iniciativas “ODS y Tierra”, “ENI Argentina” y “Land Matrix”. Su objetivo es realizar contribuciones al Estado y a la sociedad en general, para mejorar la implementación de los ODS y sus Metas relacionadas a la Tierra en la República Argentina. Cornell International Law Journal: Vol. 50 : No. 1 , Article 2 Kazakhstan ranks consistently low on measures of property rights protection and the rule of law more generally.1 Echoing these evaluations, existing literature emphasizes the degree to which informal institutions shape property relations in personalist, authoritarian regimes, like Kazakhstan. The expectation is that formal institutions like law and courts fail to restrain or otherwise influence state agents’ rent-seeking behavior. In effect, they serve primarily as ornamentation.

The Real Estate Industry is a key sector in the socio-economic development of The Gambia,
and the sector has been rapidly growing in the past decade with over 1oo real estate
companies operating in the Gambia (AREC 2020). The industry is under the purview of the
Ministry of Lands and Local Government; however, it is not regulated by Government; which
has led to consumers being vulnerable to various types of unfair, misleading and deceptive
market practices by stakeholders in the transaction process.

When you buy a home, should that also mean you have to inform the whole world where you live, how much you paid for it, and whether you financed the purchase with a mortgage loan? In essence, the Netherlands and England & Wales answer this question in the affirmative. The only thing that stands in the way of anyone accessing this information in the land registry is the payment of a small fee. In Germany, on the other hand, access to this personal data is restricted to the person who can show a legitimate interest in the information.

The country profiles on the housing sector are intended to assist Governments of countries with economies in transition to improve the performance of their housing sector and, at the same time, to promote sustainable development. The reviews analyse trends and policy developments and make an overall assessment of the political, economic and social framework of the housing sector. This work was initiated by the United Nations Economic Commission for Europe (UNECE) Committee on Housing and Land Management in the early 1990s in response to requests from UNECE member States.

While there is no right to land codified in international human rights law, the Convention for the Elimination of All forms of Discrimination against Women (CEDAW), provides for women’s right to own and inherit property without discrimination on the basis of sex. Afghanistan ratified CEDAW in 2003, without reservations. CEDAW (Article 14) also calls for rural women to have equal access to economic opportunities, to credit and loans, social security programs, and to adequate living conditions, including access to housing.

At the beginning of this textbook, the authors would like to make two suggestions about how to approach the study of property law.
