Customary Leaseholds (Enfranchisement) Act, 1968 (No. 47 of 1968).

This Act makes provision for the enfranchisement of land held under customary tenure and provides that any enfranchised land shall vest in the person who immediately before the effective date, held the land as a tenant. Rights of landlords shall be extinguished but a landlord shall be entitled to receive compensation from the person in whom the enfranchised land is vested. The Minister may establish Customary Land Tribunals for purposes of this Act. The Act defines functions and powers of such tribunals.

This Chapter concerns the procedures for the application for a permit “to excavate, fill or borrow” tidelands, defines traditional and customary rights of the people of the Chuuk State in respect of tidelands and the granting of (ownership) rights in respect of such land by the State to people of Chuuk. Tidelands within the meaning of the Chuuk Constitution are those marine lands from the shore to the face of the reef that are shallow enough for traditional fishing activity by women.

This Federal Law guarantees the traditional rights of sparsely distributed indigenous peoples to protect their natural habitats, traditional ways of life, economic activities and fishing and hunting rights. An ethnic community with fewer than 50,000 persons living on ancestral land and maintaining traditional ways of life and community management shall be considered a sparsely distributed indigenous peoples.

This Code of Laws, made under the Native Land Act, governs native land rights in specified islands of Tuvalu. The Code contains rules relative to land ownership rights and the limitation of such rights by the Land Court. The Code also concerns alienation of rights and the distribution of an estate inter vivos, in case of absentee owner, by will and without a will. Rules also concern exchanges of property, sale of property and use of (village and communal) land.

This Chapter confirms, with certain exceptions, law established during the Japanese administration which declared all marine areas below the ordinary high watermark to belong to the government. Certain customary rights to place and maintain fish weirs or traps are re-established. Other exceptions concern customary rights of owners of land abutting the ocean to collect coconuts and other materials and fishing rights on, and in waters over reefs where the general depth of water does not exceed four feet at mean low water.

This Act concerns the validity of claims of prescription which may be lawfully made at common law or by custom to any way or other easement or to any watercourse or to the use of any water, to be enjoyed or derived upon, over or from any land or water. The Act, among other things, sets out criteria for the computation of the period after which a claim shall be held valid.

Expropriation Procedure Act (R.S.S. 1978, c. E-16).

The present Act lays down provisions relating to the procedure for expropriating lands and for determining compensation for expropriated land. The Act – consisting of 51 sections - deals with the following matters: restriction on expropriation, public and private rights, entry on land prior to expropriation, procedure and effect of expropriation, mines and minerals, compensation and actions for compensation. One Schedule is enclosed.

Surface Rights Acquisition and Compensation Act (R.S.S. 1978, c. S-65).

The present Act lays down provisions relating to the acquisition of surface rights to land and the determination and payment of compensation. In particular, the purposes of the Act are: a) to provide for a comprehensive procedure for acquiring surface rights; b) to provide for the payment of just and equitable compensation for the acquisition of surface rights; c) to provide for the maintenance and reclamation of the surface of land acquired in connection with surface rights acquired under this Act.
