Isabel Province Conservation Management Ordinance 1993.

The purpose of this Ordinance is to assist owners of land to protect and manage their land and land based resources for conservation, custom spiritual and amenity purposes. Any owner of land may apply to the Isabel Province Executive for a declaration that part or all of their land be set aside as a Conservation Area (sect. 4). The Executive may declare Conservation Areas under section 5. Section 6 concerns amendment or removal of the status as Conservation Area. A notification of a declaration as Conservation Area shall be published and distributed as prescribed in section 8.

L’un des problèmes cruciaux auxquels font face les peuples africains est celui de la gestion des terres fertiles. C’est le cas du peuple akposso. Dès les origines, ce peuple avait établi sa tradition dans le domaine foncier et n’était pas prêt à partager ses terres avec autrui. Mais pendant la colonisation, l’Allemagne et la France ont eu leurs propres codes fonciers. De même, en 1974, l’Etat togolais a entrepris une réforme agro pastorale. L’étude de cette évolution du droit foncier montre des différences entre le droit foncier coutumier akposso et le droit foncier moderne.

The history of land rights in the Lao People’s Democratic Republic (Lao PDR), hereafter referred to as Laos,  is a history of customary land tenure systems which remain the most prevalent form of land tenure. As social systems, land tenure systems in Laos have been affected by and have adapted to external forces such as neighboring kingdoms, colonialization, geopolitics and war, migration, and global economic trends. Ongoing rapid changes in national socioeconomic conditions and domestic political goals continue to alter the customary tenure landscape.

Context and backgroundDespite a social recomposition marked by the abolition of slavery and the emancipation of the layers of servile origin, access to land ownership rights for descendants of servile origin is far from guaranteed in Mauritania. Customary law based on Islamic jurisprudence stands up to the law of 1960 and the decrees of 1983 and previous legal reforms; in short, the modern legal arsenal does not elucidate, justify or facilitate equitable access of the descendants of the former servile strata to land like other landless Mauritanian communities.
