Urban Lands Lease Holding Proclamation No. 80/1993.

A Proclamation to provide for the utilization of urban land. Urban land is defined as all land within the boundaries of a town (sect. 2). The Proclamation shall not apply to land previously utilized for the construction of dwellings (sect. 3). Section 4 provides for applications of persons who desire to hold urban land in lease. Such applications shall be submitted to the town administration.

The Land Code makes provision for the regulation of "land relations" and its purpose is to secure rational use and protection of land, the protection of the environment, and "the equal development of all forms of economic activity in Tajikistan" (Preamble). Other laws regulating land relations may be enacted on the basis of this Code.Land is declared to be in exclusive ownership if the State in article 2.

This Act concerns rural land. The Act consists of 15 sections divided into 4 Parts: Preliminary (I); Acquisition and Alienation of State Land (II); Occupation of Land by Person Other Than Owner Not Involving Subdivision (III); General (IV).Communal land and other specified types of land are excluded from the operation of this Act (sect. 3). Section 5 provides for the acquisition of land by the State; section 6 for the alienation of State land.

The purpose of the Act is to enact an act to support a long-term hire of immovable property. The Act prescribes the rights under a contract of hire as real right in the interest of the transfer of the rights of hire, devolution of an estate, and subletting which shall enhance the hire of immovable property for use in the commercial or industrial business in the long term.A lease of a land which has an area exceeding 100 rai shall require the approval of the Director-General in accordance with the rules, procedures and conditions prescribed in the Ministerial Regulations.

The Act consists of 95 sections divided into 8 Parts. In Chpater I of Part I the various types of agricultural tenancy are defined. Chapter 2 contains general provision as to new types of tenancy. Part 2 provides for the tenant's right to buy land. Part III concerns diversification of use of land under agricultural tenancy. A tenant under a tenancy mentioned in section 39(1) who intends to use the land for a non-agricultural purpose must send a notice to the landlord. The landlord may object to the notice of diversification under certain circumstances (sect. 40).

This Act provides protection for and regulates tenancy for agricultural purposes of land of not less than one acre nor more than fifty acres whether with or without buildings. The Act applies also to some other agricultural land tenancy. The Act prescribes statutory terms of tenancy according to the cultivation purposes of the land and sets out statutory conditions for a tenancy contract.

This Act defines: the liability of an occupier of a leased area or premises including a leased or licensed area under the Marine Farming Act 1971 in respect of visitors or licensees of the leased premises; and the relationship with respect to liability between a tenant and landlord. The Act also defines some duties of a landlord with respect to maintenance of the leased premises.
