Esta publicación compartida por la FAO y Naciones Unidas-Hábitat trata de comprender y definir mejor los procesos, los mecanismos y las instituciones de la gobernanza de la tenencia en áreas rurales y urbanas. This publication describes the experience of a number of transition countries in Central and Eastern Europe and the former Soviet Union with crafting regulatory frameworks for irrigation water users’ organizations. It also seeks to distil a number of key regulatory requirements. As a result, this study serves as a design/drafting manual for policymakers and for drafters of legislation on water users’ organizations.

Land Tenure Working Paper 11. This co-publication of FAO and UN-HABITAT seeks to better understand and define the processes, mechanisms and institutions of governance of tenure in rural and urban areas. The paper recognises that excellent land policies, laws and technical reforms have been developed. However, in many cases their implementation has slipped, stalled or even been reversed. By adopting a governance and political economy perspective, the paper offers insights for the design of reforms and for the development of land governance tools.

It begins by providing an overview discussion of the diversity of natural resources in developing countries, and rights of access, tenure and governance relevant to the rural poor, who are disproportionately dependent on natural resources.

The latter publication explains what compulsory acquisition and compensation are and what constitutes good practice in this area. This current volumes introductory article provides an overview of these issues. The issue of compulsory acquisition from a human rights perspective is also addressed here as are the concepts of market value, compensation value and just terms compensation.

El presente documento de debate ha sido elaborado por la Unidad de Gestión y Tenencia de la Tierra de la FAO con el fin de obtener opiniones y comentarios acerca de las Directrices Voluntarias para la gobernanza responsable de la tenencia de la tierra y los recursos naturales.
