The Act provides that all deeds, conveyances, wills and instruments in writing whereby any land or interest in or affecting land other than land registered in accordance with the Registered Land Act, may be affected shall subject to compulsory registration in the Deeds Registry Office. The Minister may exempt certain leases from this requirement.

Law No. 898-IV “On mortgage”.

This Law shall be applicable to immovable property, including land plots and objects located thereupon. It establishes that mortgage shall originate either in accordance with a contract or by court decision. In case of transfer in mortgage of a plot of land with constructions located thereupon the aforesaid plot of land shall be transferred in mortgage together with the aforesaid constructions. Prohibition and restrictions related to expropriation and alienation of land plots established by Land Code shall be applicable also to mortgage.

The present Law also amends new articles of the Village Law of 1924, the Law on Natural Disasters 1959, and the Tourism Incentives Act of 1982. The formation of the technical teams is re-defined. The in-forest pastures and grazelands are re-defined by a committee set up by the Ministry of Environment and Forestry and cannot be used for any other purposes unless their allocation purposes are modified.

National Land Code (Amendment) Act 2001

The present Act lays down provisions to amend and supplement the National Land Code. First of all, section 2 provides for the amendment of the long title of the National Land Code: the words “Selangor and Trengganu”are hereby replaced by the words “Selangor, Terengganu and the Federal Territory of Kuala Lumpur”. The same amendment is laid down to the Preamble. Further linguistic amendments concern the names of official authorities and institutions (section 4). Moreover, the Act lays down amendments dealing with the application related to estate lands.
