Communal Property Associations performance; Constitutional Court judgment: implications for Commission on Restitution of Land Rights; with Deputy Minister

The Committee was briefed by the Department of Rural Development and Land Reform (DRDLR) on the performance of Communal Property Associations for March to December 2015. In all, 1 483 Communal Property Associations (CPAs) had been registered since the passing of the Act and 48 were registered in the 2015/16 financial year. The CPAs had been afflicted by a number of problems and the Department had taken steps to address them by the establishment of CPA District Fora to serve as a platform to share experiences.

The Deputy Minister tendered apologies on behalf of the Minister and the Director General for their absence due to other ministerial commitments.

The Commission on Restitution of Land Reform (Commission) briefed the Committee on responses to the South African Human Rights Commission (SAHRC) findings on systematic challenges affecting land restitution in South Africa. The brief focussed on the background of the SAHRC investigative hearing, summary of the findings of the SAHRC, strategic plan of the commission, and response on each finding and recommendations of the SAHRC.

Paper reviews the South African experience with land reform, and land redistribution in particular, up to the end of 2005. Looks at various aspects of market-based land reform – landowner veto on participation in land reform; payment of ‘market prices’ for land; self-selection of beneficiaries; focus on ‘commercial’ forms of production; prominent role for the private sector in provision of credit, extension, and other services.
