The present Regulation provides guidelines to the Ministry of Environment and Forestry on planning afforestation activities: (i) Preparation of afforestation projects; (ii) Selection of areas for afforestation; (iii) Organizing forest - social community relations; and (iv) Preparation of annual programs and location distribution tables. One year prior to afforestation, all trees and shrubs that are classified as non-economic will be cleared from the area.

Assignment to provinces under the Mountain Catchment Areas Act in accordance with section 235(8) of the Constitution of South Africa (GN. R. 28 of 1995).

This Notice of the President of South Africa, made pursuant to section 235(8) of the Constitution, assigns the administration of the Mountain Catchment Areas Act, excluding certain functions that fall outside the functional areas specified in Schedule 6 to the Constitution, to a competent authority, to be designated by the Premier of the province concerned, within the jurisdiction of the government of a province mentioned in section 124 of the Constitution. The Notice defines the extend of the assignment (the whole Act except section 8(2) and amend the Act as specified in the Schedule.

This Decree lays down provisions for implementing Provincial Act No. 21 of 21 October 1996 relative to the forestry sector. The Decree is divided into three Titles and contains two Annexes. Title I regulates the hydrogeological and forest bonds referred to in article 3 of Provincial Act No. 21 of 1996. Article 2 concerns its removal under certain circumstances. Title II lays down particular provisions for bound lands. Part I of Title II regulates the transformation of forests. Article 4 gives the definition of forest.

The present Regulations implement, for Scotland, changes made to Council Directive 85/337/EC, implemented by the 1998 Regulations, made by Council Directive 97/11/EC. They also implement the extension of both Directives to the Contracting Parties of the European Economic Area (EEA) under Article 74 and Annex XX paragraph I.1 of the Agreement on the European Economic Area, as given effect by Decision No.20/1999 of the EEA Joint Committee adopted on 26th February 1999.

This Decision of the Prime Minister concerns so-called PAM forests, i.e. forests planted with the World Food Program aid capital. It outlines principles of management and use of such forests and lays down conditions for PAM forest owners. It also outlines rights and duties of Pam forest owners in specified regions and as regards certain forest areas. Forest owners shall be entitled to fully own PAM forests on land planted for production forests and protective forest in "less crucial" regions, and local protective forest within villages.

Regulation on assessment of forest management and transfer of forests to forestry enterprises.

Assessment of forest management in forests pertaining to kolkhozes and agricultural enterprises shall be carried out with a view of transfer thereof to the state forestry enterprises for the purpose of economic and ecological revaluation of forests. Forest officers through on site inspection shall carry out assessment of forest management.

These Regulations, made by the Minister of Forestry under section 13 of the Mountain Catchment Areas Act, implements provisions of that Act in respect of: the constitution and composition of Fire Protection Committees; the election of members of advisory committees for Mountain Catchment Areas; applications for financial aid; declaration of private land as Mountain Catchment Area and relative procedures; directions to owners of land in a Mountain Catchment Area; and applications for compensation of patrimonial loss.
