This Act adds a new section to the subdivision legislation of Guam so as to clarify the rights and obligations relative to public access and utility easements and thereby resolve a possible source of conflict among neighbours. The Act provides for clearer description and accurate registration of rights relative to an easement, access, roadway or right of way. The Act further defines the duties of the Department of Public Works in respect of development of rights of way and defines the right of way and especially the duties of a subdivider to grant a right of way free of any encroachments.
