AfricanLII liberates public legal information in Africa.<

The Seychelles Legal Information Institute (SeyLII) offers free and anonymous access to case law, legislation and secondary legal materials from the Seychelles. SeyLII is an independent, self-funded organisation and needs your support.

SeyLII was established in 2012 under the auspices of the Judiciary of Seychelles and with the support of AfricanLII.  It became an independent registered association in 2015. SEYLII is a member of the international Free Access to Law Movement and subscribes to the principles of the Declaration on Free Access to Law

The vision of SeyLII is to be the primary legal resource institution in Seychelles, providing free, reliable online access to essential Seychelles legal resources. These core resources have not previously been readily or cheaply available to most citizens of Seychelles. They make it easier for practitioners and judges to research the law, to prepare cases for hearing, and to write fairly researched judgments and decisions, and for lawyers and non-lawyers (both local and international) to understand and monitor the changing nature of Seychelles’ legal environment.   

In addition to providing a portal for case law and legislation, SEYLII aims to increase public awareness of the operations of the domestic courts and the broader legal profession, thereby improving access to the courts and strengthening public confidence in the administration of justice.

Tenant's Rights Act (Cap. 235).

This Act makes provision with respect to security of tenure. It provides for the protection of tenants by defining their rights and by allowing statutory tenants to register with the Registrar of Tenants' Rights appointed under this Act. The Registrar may require the Government to compulsory acquire premises under the Lands Acquisition Act for purposes of protection of rights of an applicant for registration. The Registrar may apply to the Registrar General for the subdivision of any land where the Minister certifies that the subdivision is desirable to give effect to this Act.

Small Holdings Act (Cap. 224).

This Act makes provision with respect to small holdings i.e. any land or parcel of land with or without a dwelling house or other building erected or to be erected thereon not exceeding in all five acres in area let for agricultural purposes and of a specified maximum total value. The Act specifies the (contractual) rights of a tenant of a small holding including the use and enjoyment of all ground crops, plants, fruit trees or other trees. The Act also specifies rights of the landlord and provides with the resolution of disputes between the parties to any contract under this Act.

Right of Access to Islands Act (Cap. 204).

This Act defines the right of access private islands of the Seychelles by a government officer and powers which may be exercised by Government officer. It also concerns the exercise of government functions by such officer. Any person shall have the right of access in case of an emergency to an island in private ownership. A government officer may, in exercise of his or her functions, among other things: inspect livestock and plantation on the island and fell any trees, lop branches and remove vegetation or brushwood on the island.

Mortgage and Registration Act (Cap. 134).

This Act provides rules for the registration of mortgages and provides for the continuation of the Mortgage and Registration Office. The Act defines the legal effects of the transcription of a mortgage. The Act also provides for the registration of other rights on land including: (a) every deed of transfer inter vivos of any immovable property: (b) every deed constituting any pledge of immovable property or any servitude over or right of use in any immovable property; (e) every judgment of adjudication; (f) every lease of rural property.

Lands Acquisition Act (Cap. 105).

This Act provides rules for acquisition land in the public interest, including compulsory acquisition, and related matters such as claims to compensation, examination land and taking possession of land, mortgages over land compulsory acquired, registration of interest in land and (effects of) withdrawal from acquisition.

Repealed by: Acquisition of Land in the Public Interest Act (Cap. 1A). (1996-06-03)
