This group of indicators assesses whether national laws comply with Section 16.5 of the VGGTs. Section 16.5 of the VGGTs states “Where the land, fisheries and forests are not needed due to changes of plans, States should give the original right holders the first opportunity to re-acquire these resources. In such a case the re-acquisition should take into consideration the amount of compensation received in return for the expropriation.”
