Nitrate Sensitive Areas (Designation) Order, 1990.

Authorized under section 112 of the Water Act 1989 (a summary was published in FAO Food and Agricultural Legislation No. 39, Dec. 1990, p.51), this Order designates certain lands as Nitrate Sensitive Areas (Schedule 3) to prevent or control the entry of nitrate into controlled waters in connection with the use of any land for agricultural purposes. This Order applies to England only.

This text consists of 6 articles. Article 1 establishes the concept of precinct forests defined as the inland and marine fisheries domain and reserved for fishery productivity. Article 2 subjects the issuing of the land property in the precinct forest to the approval by the Ministry of Agriculture. The conduct of activities such as clearing, chopping, reclaiming or burning is prohibited unless prior authorization of the Ministry of Agriculture has been granted (art. 3).

No person may discharge any effluent liquid onto land or use any effluent liquid for the irrigation of any land, without appoval by the appropriate health authority (sect. 3). No person may use any effluent liquid from any sewage-treatment installation or oxidation ponds for the irrigation of any land where crops for consumption are present (sect. 6). No person may use such liquid for the irrigation of any land within 200 metres of an occupied dwelling or 50 meters from any road using sprinklers, unless such liquids comply with standards as set out in the Schedule (sect. 7).

The Act provides the framework for Conservation Authorities. The Authorities are bodies corporate for the purposes of establishing and undertaking, within their respective jurisdictions, a program designed to further the conservation, restoration, development and management of natural resources other than gas, oil, coal and minerals (sect. 19). The Authorities are based on watershed boundaries and have the following powers: preparing watershed programmes; data collection; acquiring, leasing and expropriating land; erecting works and structures (sect. 20).

The Act provides for the conservation and efficient use of of land, forest and water resources in the Province of Alberta. It provides for the establishment of the Conservation and Utilization Committee to inform and recommend measures to the Lieutenant Governor in Council (LGC). Subject to approval by the LGC, the Committee may carry out recommended measures related to the conservation and utilization of irrigable, marginal and submarginal lands, rivers and streams or forestry and game areas.

El Reglamento consta de 288 artículos y reglamenta las normas relacionadas con el recurso agua en todos sus estados. Declara, a tenor del artículo 1º del Decreto Nº 2811/74, de 18 de diciembre de 1974, que la preservación y manejo de las aguas son de utilidad pública. La administración y manejo del recurso hídrico corresponde al Instituto Nacional de los Recursos Naturales Renovables y del Ambiente (INDERENA), salvo cuando haya sido adscrita a otras entidades.

The Act makes provisions for the conservation and improvement of the land and water resources. It establishes the Land Conservation Board (sect. 3) to exercise general supervision over land and water resources (sect. 5a) and to make conservation orders (sect. 7), closing orders (sect. 8) and orders to do work (sect. 9). Conservation Committees may be established to advise the Board. (23 sections)

With a view to effecting the environmental protection of the bed of rivers and lakes, which dry up and become exposed as a result of a natural or man-made change in the former course of the river or surface of the lake, the statute reverses the rules governing ownership of newly-exposed river or lake beds (called riveraine and lacustrine "appurtenances"), which henceforth shall accrue to the State in lieu of the owners of riparian or coastal land.
