This paper starts from the assumption that the process of reform is as important as the content of the reform. Many excellent land policies, laws and technical reforms have been developed, yet, in many cases, implementation has slipped, stalled or has even been reversed. The paper argues that an understanding of land issues and the reform process from a governance and political economy perspective offers insights that can not only improve the design of reforms, but can also offer tools to support implementation.

This Act, among other things, recognizes the Minerals Management Board as established by section 214 of the Constitution and provides rules relative to exploration and exploitation of minerals in Swaziland. The Act defines functions and powers of the Board, establishes an office of the Commissioner of Mines and defines functions of the Commissioner of Mines. A distinction is made between small-scale and large-scale operations for the purposes of this Act.

This Regional Law establishes the composition of land-use planning documentation that must contain mapping of the territory, copy of decision of land expropriation (including bail out), land reservation for public and municipal needs, mapping of the boundaries of land servitude, and project documentation containing graphic maps.

This Regional Law establishes the modalities of elaboration and submittal of land-use planning documentation by the competent bodies of local self-government. Decision-making related to land-use planning projects shall be made (or rejected) by the competent body within ten days from the date of submittal of land-use planning documentation.
