The 19 sections of this Act are divided into 6 Parts: Citation and Interpretation (I); Establishment of Land Surveyor's Board (II); Licensing and registration of Land Surveyors (III); Discipline (IV); Appeals (V); Miscellaneous (VI).A Board to be known as the Land Surveyors' Board is established under section 3. Rules laid down in Schedule I apply to the constitution of the Board. The Board shall organize land surveyor examinations, consider applications for land surveyor licences, and institute disciplinary legal proceedings in accordance with provisions 10 to 12 (sect. 5).

The Act provides for powers of land surveyors to carry out land survey of boundaries of estates and for procedures of such survey, the review of surveys and the inclusion of surveys in survey plans. Notice of land survey shall be given 7 days prior to survey and shall be in the form as set out in the First Schedule. A warrant of land survey shall be issued in a prescribed form by a judge if survey is carried out to establish boundaries of adjoining lands in order to resolve a land dispute (sect. 6).

According to articles 65, 66 and 67 of the Land Code (1991), National Land Cadastre should provide information, to all citizens and every kind of organization, for the safeguard of efficient land use and land protection, for the harmonization of laws on land use and landownership, for the organization of proper use of land, as well as for the qualitative description and evaluation of the land, and for other issues related to land use. Surveys on the status of the land (monitoring) are conducted in conformity with uniform standards.

Persons having acquired a just and lawful right of title in derelict lands, either by prescription or by contract or in any other manner, may apply to the High Court to order the registration of such title (sect. 3). Section 4 provides for the application for the registration of land by persons entitled to "expropriate" such land. Section 5 provides for the application to the high Court for relief by persons having a claim on derelict land.

This Act provides rules relative to the survey of land. consists of 49 sections which are divided into 9 Parts: Preliminary (I); Administration (II); Recognition and Duties of Land Surveyors (III); Original Surveys and Re-surveys (IV); Division Surveys (V); Townships (VI); Beacons and Boundaries (VII); General Plans and Diagrams (VIII); Miscellaneous (IX).At Harare a Surveyor-General's Office is established (sect. 7). A Survey Regulations Board is established under section 8. The Board may make Regulations, with approval of the Minister, prescribing matters specified in section 9.

The text of the Act opens with an extensive interpretation section. It includes definitions of "contiguous", "diagram", "erf", "land surveyor", "owner", "reference mark", and "township". The Minister shall appoint a Chief Surveyor-General (sect. 2). The Chief Surveyor-General shall be in charge of such geodetic, topographical and cadastrial survey and land information services in the republic as the Minister of Agriculture and Land Affairs may direct and shall perform the duties specified in section 3. Offices of the Chief Surveyor-General may be established in the provinces (sect. 4).

This Act makes provision for the registration of property and other rights on land and buildings on land, aircrafts and ships as required by law. Pursuant to article 3 there is established a Cadastre and Public Registers Agency which shall be responsible for the keeping and administration of Public Registers. For each office of the Service there shall be appointed a Land and Public registers Registrar (art. 6). Chapter 2 makes provision for the form and contents of public registers in which rights on goods which require registration are registered.

By making further provision for the registration of property and other rights on land and buildings on land, aircrafts and ships as required by law, this Decree implements and supplements various articles of the Cadastre Act. Article 2 prescribes in detail how real property shall be recorded in the Cadastre. Chapter II requires certain information to be submitted for registration of property rights in the Public Register. Chapter III makes provision for the updating of cadastrial registration and cadastrial maps. Chapter IV regulates the updating of registration of ships.
