La présente ordonnance porte règlement minier. Elle comprend 165 articles répartis en 6 titres, à savoir: Généralités (I); Régime minier de droit commun (II); Régime minier conventionnel (III); Relation des titulaires de droits miniers avec les propriétaires du sol entre eux et avec l'Etat (IV); Dispositions particulières aux hydrocarbures (V) et Entrée en vigueur du règlement (VI).En vue de susciter une mise en valeur rapide des ressources minières, les surfaces à octroyer ont été fixées dans des limites raisonables.

La presente Ley sobre el régimen de propiedad de tierras de Guinea Ecuatorial, establece que se distinguirán las tierras según pertenezcan a particulares y entidades, o formen parte del patrimonio del Estado; estas últimas se dividirán en tierras de dominio publico y tierras de propiedad privada del Estado.

El presente Reglamento regula la obligación de los órganos de la administración del Estado de escuchar y considerar la opinión de las organizaciones indígenas cuando traten materias relacionadas con cuestiones indígenas, según lo establecido en el artículo 34 de la Ley Nº 19.253 sobre protección, fomento y desarrollo de los indígenas. En especial se define y regula el procedimiento de consulta y se establecen disposiciones detalladas en tema de participación.

El presente Decreto incorpora algunas modificaciones al Título III del Reglamento de la Ley del Servicio Nacional de Reforma Agraria, el cual regula el régimen y los procedimientos de distribución de tierras fiscales. El objetivo de estas modificaciones consiste en asegurar una distribución más ágil y expedita de las tierras fiscales disponibles a favor de pueblos y comunidades indígenas, campesinas y originarias sin tierra, o aquellas que las posean insuficientemente.

This Act makes provision with respect to the recognition of tribes and certain matters regarding the administration of tribes, i.e. the institution of traditional leadership by a person designated by the tribe and recognized by the Minister.The Act, among other things, sets out the procedures for the designation and recognition of traditional leaders, provides for appeal against decisions of the Minister, defines the functions of traditional leaders, defines the jurisdiction of courts in matters of administration of tribes and defines regulation-making powers of the Minister.

In particular, the Law amends, inter alia, article 3 dealing with authorizations; article 17 concerning the environmental ombudsman; article 18 regarding the environmental impact assessment; article 24 on compensation payments; and article 61 on implementation of Community Law.

An Act to provide for matters relating to land within urban areas or urban communities declared by Order of the Minister in accordance with sections 2 and 3. The leases on land situated within urban communities are transferable freely between natural persons and/or bodies corporate subject to the following provisions: (a) all applications for the transfer of leases shall continue to be submitted to the Ministry of Lands for approval with copies given to the custom owners or their legal representative, or to the Municipality in the case of public land.
