Multi-sectoral partnerships for low income land development in Brazil

This work looks into the potential use of various instruments which rely on a close interaction between different segments of society (the public, the private and the third sectors) for increasing low income urban land development in Brazil. It is based on the recognition that the Brazilian housing problem is serious, threatening the development and environment of urban centres in the country, being also intimately related to the difficult access to adequate land by a significant portion of the urban population.

The World Food Summit in 1996 set the goal of reducing by half the numbers of malnourished people in the world by 2015. It is unlikely that this will be reached, and particularly not in Sub-Saharan Africa (SSA). Food imports in SSA have increased in the past forty years, since domestic production could not keep up with population growth. Several studies have reported about this stagnating food production in SSA. However, this region encompasses a large number of countries, with a great variety of agro-ecological zones and large differences in land, labour and other resources.

Land degradation is a large problem worldwide, especially in agricultural areas. Between 1-6 billion ha of land worldwide is affected by land degradation. With an increasing world population, more food production is needed and, therefore, more land is converted into agricultural areas. This conversion of land to agricultural areas, in turn, leads to more land degradation. Some common forms of land degradation are desertification, salinization and soil erosion by water. The negative effects of soil erosion have been recognized for a long time.

La presente Ley establece normas tendientes al control y prevención de todo proceso de degradación de los suelos; a la recuperación, habilitación y mejoramiento de las tierras para la producción; y a la promoción de la educación conservacionista. El objetivo es asegurar los medios para adecuar la utilización de la tierra, conforme a su aptitud, manteniendo el equilibrio de los ecosistemas de manera de evitar el deterioro de la economía provincial y teniendo en cuenta las posibilidades reales y efectivas de los usuarios.

This Regional Legislative Decree, consisting of 18 articles, adapts Law No. 54/2005 on the ownership of water resources to the legislation of the Autonomous Region of Madeira. It regulates the following land ownership issues: Land near the crest of the cliffs reached or inserted in consolidated urban centres; Process of recognition of private property on public land parcels; Administrative easements on private plots of beds and public water banks; Areas threatened by the sea or floods, etc.

Implements: Law No. 54/2005 on the legal regime of water domain. (2005-11-15)

Planning of Peatland Ecosystem Protection and Management is done through the following stages: 1. Peatland Ecosystem inventory; 2. Determination of the function of the Peat Ecosystem; and 3. Drafting and establishing the Peatland Ecosystem Protection and Management plan.
