The present Law lays down provisions relating to land survey and land cadastre in the Land Nordrhein-Westfalen. The tasks of the public survey and mapping authorities include the collection, keeping and dissemination of data concerning land survey and land registration. The said Office has to avail itself of the latest technical and scientific progress.

The purpose of the state land use planning, state land cadastre and land monitoring shall be rational management of land and environmental protection. Basic principles of the state land use planning shall be: (a) respect for the rights of landowners; (b) use of land resources prevalently for agriculture; and (c) creation of favourable conditions for rational land management and improvement of soil fertility. The Act consists of four Sections divided into 22 articles: (1) general provisions; (2) the state land cadastre; (3) land monitoring; and (4) state land survey service.

This Decree shall be compulsory for all natural and legal persons carrying out geodetic activity, topographic activity, survey, mapping and keeping of land cadastre. National Geodetic Supervision Service shall be the authorized institution for issuance, renewal, validation, restriction and revocation of authorization to natural and legal persons in accordance with the form contained in the Annex 2. Authorization shall not be required for the correction of agricultural land areas maps, land use planning and forest organization maps and charts.

This By-law, consisting of 45 sections completed by one Schedule, provides for the implementation of the Crown Lands Act 1989 by providing specifications on Trust Boards (Part 2, div. 1) and other administrative matters, on the access to and use of reserves (Part 3) and on various matters related to the management of reserves (Part 4). The attached schedule provides a lists of the reserves to which this By-Laws applies.

These Regulations specify the requirements for applications for planning permission under the Town and Country Planning Act 1971. They also provide that a local planning authority that is to determine an application may direct an applicant to: (a) supply any further information to enable them to determine the application; or (b) provide one of their officers with any evidence in respect of the application as is reasonable for them to call for to verify any particulars of information given to them.

These Regulations amend the Planning (Listed Buildings and Conservation Areas) Regulations 1990 and the Town and Country Planning (Applications) Regulations 1988 in relation with an application for outline planning permission and “reserved matters”, applications made to local planning authorities for listed building consent or conservation area consent and design and access statements which are required to accompany applications for listed building consent.
