These Regulations amend the Action Programme for Nitrate Vulnerable Zones (Scotland) Regulations 2008 so as to implement Commission Decision 2009/431/EC granting derogation to England, Scotland and Wales pursuant to Council Directive 91/676/EEC concerning the protection of waters against pollution caused by nitrates from agricultural sources.The Regulations provide for a derogation from the annual farm limit of nitrogen in livestock manure which may be obtained from the Scottish Ministers by an occupier of any grassland farm within a nitrate vulnerable zone.

By establishing an action programme for nitrate vulnerable zones these Regulation implement, as regards England and Wales, the requirement in this respect as laid down in article 5 of Council Directive 91/676/EC concerning the protection of waters against pollution by nitrates from agricultural sources. Regulation 3 requires an occupier of a farm or livestock unit comprising all or part of a nitrate vulnerable zone to ensure that the action programme set out in the Schedule is implemented. The purpose of this Act is to regulate general principles governing the limits of ownership of lands by individuals in the country. In particular, no one may own more than a certain amount of land in the whole country. Any land in excess shall be seized by the Government and redistributed. Fruit and tea gardens, as well as agricultural land are exempt from this limitation. Abandoned land, wasteland and land exceeding the maximum permitted, are considered eligible for division and redistribution. According to the Act, farmers are considered as priority in land redistribution.

This Regional Law establishes plenary powers of the regional Legislative Assembly, Governor, Regional Government and authorized regional state executive body in the sphere of land relations. It also establishes maximum agricultural land area (150 ha) and minimum agricultural land area (0, 5 ha) of public and municipal land that can be allotted in ownership for farming. The aforesaid plots of land can be allotted once-only.
