Order No. 1318 on commercial keeping of livestock, manure, silage.

The Order sets regulations on manure use with the purpose of establishing standard animal keeping compounds and storage of such biomass. In Chapter 2 it sets regulations on the establishment of facilities, as well as extensions and modifications thereof for animal husbandry; these shall not be authorized if causing pollution. Stables and similar enclosures for animals shall be designed so that contamination of groundwater and surface water does not occur. They must have floors constructed of durable materials which are impermeable to moisture.

This Regional Law lists categories of citizens that shall have the right of allotment of plots of public or municipal land free of charge within the boundaries of urban areas. The aforesaid plots of land can be allotted to peasant farms for agricultural purposes and farming. Horticulture and gardening. Maximum land area that can be allotted to peasant farm shall be 40 ha, minimum land area shall be 1 ha.

This Act establishes the Agricultural and Rural Development Authority under section 3 as a body corporate. The operations of the Authority shall, subject to this Act, be controlled by a Board constituted under section 5. These Regulations provide for the payment of aid to farmers who undertake to introduce organic farming methods and comply with certain environmental management conditions, pursuant to Article 2(1)(a) and (d) of Council Regulation (EC) No. 2078/92 and implement Commission Regulation (EC) No. 746/96 laying down detailed rules for the application of the Agri-environment Regulation. Article 3 shall be amended to add the following wording: “Regional Legislative Assembly shall be responsible for establishment of maximum and minimum land areas out of stock of public or municipal land that can be allotted to citizens for farming”.

This Proclamation of the Benishangul Gumz Regional State shall apply to any rural land found in the region. It mainly is concerned with land rights land use and administration of rural lands. Land is declared the common property of the state and people and it shall not be subjected to sale or other means of exchange. Any peasant who legally resides in the region shall have the right to hold land irrespective of gender or any other discrimination. Land administration shall be implemented through community participation. Rural land shall not be expropriated unless to use for public services.
