State Lands (Amendment) Decree 2013 (No. 7 of 2013).

This Decree amends the State Lands Act, originally titled “Crown Lands Act”, in section 6 by adding a subsection (6), which provides that any i Taukei land which is exchanged for portions of State land under subsection (3) must not be exchanged for portions of private freehold land under subsection. It also adds a new section (28a), which allows a person who is not a registered surveyor to be appointed as the Director of Lands.

Regional Law No. 111 “On particulars of turnover of agricultural land”.

This Regional Law regulates relations dealing with ownership, tenure and disposal of agricultural land plots. In order to regulate the aforesaid issues authorized regional state institution in the sphere of land relations. Agricultural land shall be used exclusively for specific agricultural purposes by methods preventing damages, such as degradation, pollution, littering up and other negative impact. Owners of agricultural land plots must carry out periodically soil fertility tests.

This Regional Law regulates relations dealing with ownership, tenancy and disposal of agricultural land. Maximum land area of agricultural land that can be owned by a single natural or legal person shall not exceed 20 percent or total agricultural alnd area within a given territory. Agricultural land plot can be expropriated in accordance with court decision in case of unpurposeful use thereof. In case of purchase and sale of agricultural land plots regional administration shall have preferential right of purchase.

La presente Ley establece el marco normativo para las áreas de reserva territoriales del Estado de Guatemala, que están constituidas por aquellas áreas: contenidas en la faja terrestre de tres kilómetros a lo largo de los océanos, contadas a partir de la línea superior de las mareas; de doscientos metros alrededor de las orillas de los lagos; de cien metros a cada lado de las riberas de los ríos navegables; de cincuenta metros alrededor de las fuentes y manantiales donde las aguas surtan a las poblaciones.

This Regional Law regulates relations in the sphere of turnover of land shares in common property and land parcels of agricultural land. It shall not be applicable to agricultural land used for gardening, horticulture, subsistence farming and individual stockbreeding. Maximum land plot area of agricultural land separated from common ownership shall be equal to land share. Maximum agricultural land area that can be owned by a single natural or legal person shall not exceed 25 percent of total agricultural land available in a given municipal unit.

The present Regulations are made under the Conservation Easement Act. In particular, the Regulations lay down provisions relating to the designation of eligible bodies. Section 4 establishes that if the Minister is satisfied that an organization complies with the present Regulations, the Minister may approve the application and recommend to the Governor in Council that the organization be designated and that its name be added to Schedule “A”. The text consists of 5 sections and 1 Schedule.

The present Act lays down provisions relating to the process for landowners and conservation organizations to protect private lands through conservation easements. For the pupose of the present Act a «a conservation easement» is the result of an agreement between a private landowner and a designated conservation organization. The easement places restrictions on the land for conservation purposes. The text consists of 18 sections.
