This Act concerns the government of Samoa. Notwithstanding anything to the contrary in any Act, or in any rule of law, or in any lease, it shall not be lawful for any person to distrain for rent. The only other provision of this Act concerns legal capacity and status of married women.

This Act consists of 54 sections divided into 5 Parts: Registration (I); Investigation of Title (II); Alienation of Niuean Land (III); Surveys (IV); Miscellaneous Provisions (V).There shall be kept in the Land Registry a Land Register of Niuen and Crown land. Every instrument affecting or relating to the title to any land shall be registered, except titles specified in section 4. The Land Court or the Land Appellate Court shall determine every title to and every interest in Niuean land according to the customs and usages of the Niuean people, as far as the same can be ascertained (sect.

The Act deals with the transfer of property from an individual to another by means of sale, mortgage (as per point a), lease, exchange (i.e exchanging the property of land with crops) or donation. In this last case, donation must be accepted by the person in the course of the donor’s lifetime. If the recipient dies before having accepted the donation, this shall be considered null.

This Act provides for the tenancy of land that shall be used for purposes other than cultivation; and for the building of residential housing or factories or for erecting shrines and temples and digging tanks. Nevertheless, the tenant or the sub-tenant is entitled to fell trees planted on that land, dispose of harvested fruits and flowers produced by the trees, and, even, to sow any plant or flower.

The Ordinance refers to a Bangladesh custom of leasing land, called barga, and to the tenant of that lease, the bargadar, who is an individual tending the land whose property belongs to a different owner. It states that cultivating land belonging to another person and sharing the resulting production is consented only under a barga contract.

This Act, except where otherwise expressly provided, applies to trusts constituted or created either before or after the commencement of this Act. Part III sets out the general powers of trustees including lease and sale of property. Part V concerns the appointment of new trustees, vesting orders, and other powers of court such as the power of Court to authorize dealings with trust property and variations of trust and the power of Court to direct sale or lease. This Act provides for recognition and protection of titles in land, administration of land, use of land for public purposes, the land court and adjudication and various other matters relating to land.The Act consists of 170 sections divided into 10 Parts: General (I); Administration (II); Hereditary estates (III); Tax and town allotments (IV); Tongan leases (V); Mortgages (VI); The Foreshore (VII); Registration of title (VIII); Land for public purposes (IX); The Land Court (X).Section 3 declares all land of Tonga to be property of the Crown.

The forms in the Schedule, or forms substantially similar, shall be used for the following purposes: (a) a notice under the provisions of section four of the Act, being a notice terminating a tenancy of the business premises to which the Act applies, shall be in Form 1; (b) a notice under the provisions of section six of the Act, being a tenant's request for a new tenancy of business premises to which the Act applies, shall be in Form 2; (c) a notice under the provisions of subsection (1) of section twenty-one of the Act, being a notice requiring a tenant of business premises to give inform

These Rules make further provision for procedural requirements fin relation with an application for new tenancy made under section 4 of the Landlord and Tenant Act and various other applications under sections 12 (order for a new tenancy), 18 (revocation of an order), 28 (determination of rent)and 7 (rent) of the Act.

A lease of State lands that was registered under the Real Property Ordinance after 27 October 2000 but before the commencement of the State Lands (Amendment) Act, 2003: (a) is valid and lawful to the extent that it would have been valid and lawful had the Ordinance provided for such registration; and (b) shall continue to be treated with, in accordance with the Ordinance, and such treatment shall be valid and lawful to the extent that it would have been had the Ordinance provided for the registration of the said lease.

This Order of the President, made under section 16(1) of the State Land (Regularisation of Tenure) Act, 1998, empowers the Land Settlement Chairman with the execution of Deeds of Lease and with the granting of consent to assignments pursuant to section 15 of the Act on behalf of the President.

The following new sections are inserted in the State Lands Act: A subsection (2) is added to section 10 concerning the registration of lease of state lands under the Real Property Ordinance. Every lease shall be notified to the Registrar-general together with a map, plan or diagram of the land leased.
