This Law shall determine types and organizational forms of enterprises, rules of their foundation, registration, re-organization and liquidation, and organizational mechanism to conduct their business under conditions of transition to the market economy. The Government, for the purpose of improvement of the mechanism of registration of payers of land charges and land rent for the land belonging to state (municipal) property, decrees to entitle district and city committees on land resources and land survey with the task of provision territorial, city and district state tax inspections with the lists of legal and natural persons – payers of land charges, compiled on the basis of the data of state land cadastre.

These Regulations concern enforcement of payment of service levy imposed under section 4A of the State Land Act. Interest is due on default (reg. 3). A Notice shall be issued on the occupier who defaults on a loan but there exists also the possibility that the loan is cancelled altogether (reg. 4). The property of the defaulting occupier may be sold on regulation 7. In case of insufficient property, a Court order may be invokes for the repossession of the plot of State land. Procedures for repossession are set out in regulation 9.

At the end of section 26 a provision is added regarding the consent of a Land Board to transfer of rights in land. Such consent is not required in the case of sale in execution to a citizen of Botswana. Section 28 is here renewed. That section concerns the cancellation of grant and recovery of possession by the Land Board in the case of breach of development covenant or unauthorised change of user. The Second Schedule contains the description of an area prescribed as tribal area in the sense of section 2 of the principal Act.

This Resolution is composed of 37 articles. Terms and definitions are given in article 1. Lands shall be divided into 3 parts: public lands, private lands and endowment lands (art. 2). There shall be two systems for land registration: individual and corporate body (art. 3). The inheritance right shall be written if it includes a land (art. 10). Rent contracts which exceed 5 years shall be registered in the appropriate newspaper (art. 13). Articles 20-26 deals with dispute settlements. The Prime Minister shall issue the Regulation for registration fees (art. 33).
