The Act has been amended as per the deletion and substitution of paragraph 1 and the insertion of a new paragraph 1A; paragraph 2, 3 and 4 underwent minor changes in terms of substitution of sentences and some additions. Any application made or pending and any order or decision of and any right of appeal of a Strata Titles Board prior to 1st May 2004 shall not be affected.

This Chapter provides for the control of practice of land surveyors in the State of Kosrae by imposing the requirement of registration and qualification for such surveyors. The Chapter imposes requirements regarding training and examination of potential land surveyors. Land surveyors shall register with the Governor who shall proceed only with registration after consultation with the Land Court and the Department of Agriculture, Land and Fisheries.

This Chapter makes provision for the survey and registration of land in the Trust Territory and provides that for this purpose there shall be a land commission in each administrative district of the Trust Territory. Each commission shall supervise surveys and proceed with the registration of as much of the land as practical within such registration areas within its district as it determines and may determine the ownership of any land in its district. This Act concern the definition of coordinated systems for purposes of land survey in the State of Chuuk and specified lagoons. The Chapter also gives some indications for a valid survey but does not require a purchaser or mortgager to entirely rely on the defined system. The Chapter also prescribes penalties for the offence of interfering with survey marks.

This Act lays down basic provisions on land tenure, both rural and urban. All land in Viet Nam is the property of the State, but individual and corporate users, both domestic and foreign, can obtain from the State usufructuary rights under lease-type contractual arrangements (art. 1). La présente loi met en exécution l’ordonnance fédérale du 18 novembre 1992 sur la mensuration officielle (OMO). Notamment, l’article 1er établit que la présente loi a pour but d’assurer l’acquisition, la gestion, la mise à jour et la diffusion des données de la mensuration officielle sur l’ensemble du territoire cantonal.
