The legal framework for land use planning and land allocation (LUP/LA) in Lao PDR has been analysed based on the relevant laws (Land Law, Forest Law, Agricultural Law etc.). A national LUP/LA program under the overall responsibility of the Ministry of Agriculture and Forestry has been created in 1996.

It provides information on the historical background of the Convention and its Optional Protocol, the working methods of the Committee, as well as a summary of information provided in reports of selected countries. While Vietnam's reforms provided some of the weakest legal private property rights amongst the transitions countries, cities like Ho Chi Minh City have booming domestic real estate markets. Interestingly, while most properties in 2001 did not have legal title, those on the market did advertise a variety of property rights claims.

Lowland immigrants are taking advantage of the vulnerable situation of indigenous people, and the absence of regulations, to lay claim to the people’s traditional lands.
This paper examines the impact of a land reform in Viet Nam which gave households the power to exchange, transfer, lease, inherit and mortgage their land-use rights. We expect this change to increase the incentives as well as the ability to undertake long-term investments on the part of households.
ABSTRACTED FROM THE INTRODUCTION: My focus in this paper is on the kinds of development pursued by state agencies and large international aid organisations, and specifically, the displacement effects of what I am calling the new land tenure reform agenda. The term "access" is frequently used by property and natural resource analysts without adequate definition. In this paper we develop a concept of access and examine a broad set of factors that differentiate access from property.
The process of decollectivization in Vietnam, leading up to the 1993 Land Law, ensured farming households the rights to market their own produce and to transfer, exchange, lease, inherit, and mortgage their land-use rights. These changes imply a reworking of relations between state, market, and household, but also within households.
