These Regulations amend the Town and Country Planning (Hazardous Substances) (Scotland) Regulations 1993 to implement Article 30 of Directive 2012/18/EU of the European Parliament and of the Council on the control of major-accident hazards involving dangerous substances, which amends Council Directive 96/82/EC on the control of major-accident hazards involving dangerous substances. They insert “heavy fuel oils” to the list of hazardous substances and controlled quantities in Schedule 1 and concern immunity from prosecution and contravention proceedings.

These Regulations transpose Directive 2006/21/EC of the European Parliament and of the Council on the management of waste from extractive industries and provides that planning permission for the management of extractive waste cannot be granted unless a waste management plan is approved by thedistrict council under these Regulations and provides that such permissions which involve waste facilities will be subject to conditions as set out in these Regulations.

These Regulations provide for the collection, transport and treatment of food waste, and for related matters. They are made for purposes of Articles 11(1) (re-use and recycling) and 22 (bio-waste), and in accordance with Articles 4 (waste hierarchy) and 13 (protection of human health and the environment) of Directive 2008/98/EC on waste. They also amend the Waste and Contaminated Land (Northern Ireland) Order 1997 and other Regulations to provide with respect to the separate collection of food waste.

These Regulations amend the Town and Country Planning (Environmental Impact Assessment) Regulations 2011. Those Regulations require that projects which are above a certain size, or meet prescribed criteria, must be screened to determine whether they are likely to have significant environmental effects and, consequently, are subject to the requirement for an environmental impact assessment.

The present Regulations are made under the Indian Act. The Regulations lay down provisions relating to the use of reserve lands. The Regulations establish that no person shall: a) operate a garbage dump in a reserve, or b) use any land in a reserve for the disposal or storage of waste, except under the authority of a permit. For the purpose of the present Regulation ‘waste” is defined to include garbage, liquid and semi-liquid substances, landfill and scrap of all kinds. The Regulations also prohibit the burning of waste.

This Order lists material in column 2 of the Schedule to this Order which shall be qualifying material for the purpose of section 42 of the Finance Act 1996. That section provides for a lower rate of landfill tax to be charged where the material disposed of consists entirely of qualifying material. The material listed in column 2 of the Schedule must not be treated as qualifying material unless any condition set out alongside the description of the material in column 3 is met.

The objective of this Decree of this Government of the Republic of Slovenia is to minimize the effects of adverse environmental impacts of the lamndfill of waste, particularly due to the effects of pollution caused by emissions of substances in surface water, groundwater, soil and atmosphere, and in the context of global environmental pollution to reduce greenhouse gas emissions and prevent risks to human health.
