This Act consists of 7 Parts: Preliminary (I); Acquisition (II); Reference to an Appeals Board and procedure thereon (III); Apportionment of Compensation (IV); Payment (V); Temporary Occupation of Land (VI); Miscellaneous (VII).The Act provides a legal framework for the acquisition of private land by the government for the benefit of the public. Procedures and requirements for the acquisiton of land are set out in detail in the text. The Act further provides for the constitution of one or more Appeal Boards for the purpose of hearing appeals in respect of any award made by the Collector.

The present Act provides for taxation of transfer of property and for gaining an interest in property that is registered at the Land Title Office. Taxable transactions include: transfer of fee simple, right to purchase or agreement for sale, lease or lease modification agreements, life estate, foreclosure, Crown grant, escheat, forfeiture or quit claim transfer as a result of corporate reorganization, The calculation of the tax is based on the fair market value of the property. The text consists of 38 sections.

Regional Law No. 3 “On calculation of land taxes and evaluation of land plots pertaining to public ownership or with undelimited ownership in case of sale thereof to owners of edifices, constructions located on the aforesaid land plots”.

This Regional Law establishes the modalities of calculation of land taxes and evaluation of land plots pertaining to public ownership or with undelimited ownership in case of sale thereof to owners of edifices, constructions located on the aforesaid land plots. In case of sale the aforesaid plots of land to commercial organizations, individual entrepreneurs, legal persons and citizens the amount of repayment shall be calculated as two and a half percent of cadastre value at the moment of purchase thereof.

Regional Law No. 7 "On cultural heritage".

This Regional Law regulates relations in the sphere of conservation, management , promotion and state protection of the objects of cultural heritage and is aimed at ensuring constitutional right of citizens related to access to cultural heritage. Objects of cultural heritage shall be considered immovable property and shall include natural landscapes, recreational urban forests and parks. Land within the boundaries of territories of cultural heritage recorded in the public register of the objects of cultural heritage shall be considered land of historical and cultural heritage.

Regional Law No. 263 “On cadastre valuation by decision of local government”.

This Regional Law establishes case of state cadastre valuation of land by decision of local government in case of approval thereof by decision of the Regional Government. Application for cadastre valuation shall contain specification of land category, draft terms of reference for cadastre valuation and substantiation of the request for cadastre valuation.

Saxon Land Survey Law.

The present Law lays down provisions relating to official land survey and land cadastre in the Free State of Saxony. Article 1 establishes that the official land survey includes the: a) land survey; 2) land cadastre including cadastre survey and marking and 3)binding evidence of real-estate boundaries. This Act establishes guidelines on surveying and mapping of cadastre through the Survey and Cadastre Authority. Survey and Cadastre Authority may, after consultation with other authorities, store and distribute related data. Surveying in Danish waters, including waters around the Faroe Islands and Greenland, may only be done with the Survey and Cadastre Authority authorization. At completion, a copy of all survey data shall be submitted to the SCA. Decisions in adherence to section 1 may not be appealed to any other administrative authority.

These Regulations set out in the Schedule forms, which are prescribed for the purposes of the provisions of the Acquisition of Land in the Public Interest Act respectively specified in each such form. They include: particulars to be furnished under section 5(3) and 5(4) of the Act; Claim for compensation under section 12; Notice under section 9(2) of an owner whose lands is compulsory acquired under section 6.

Article 19 shall be amended to add the following wording: “If general boundaries of a plot of land displayed on cadastre or geometric plan does not correspond to effective land ownership (pedis possession) and in the absence of act of land boundary establishment at land owner’s request and at the expense of local government establishes boundaries of land plot on site”.

This Law establishes legal grounds and the modalities of state registration of rights to immovable property and encumbrances, and also transactions related thereto with a view of recognition and protection by the state of registered rights, encumbrances and transactions. This Law shall be applicable to registration of rights related to land plots.
