These Regulations implement provisions of the Physical Planning Ordinance with respect to applications for: (a) a grant of development permission; (b) permission to demolish or develop a building subject to a building preservation order; (c) permission to cut or remove a plant subject to a Plant Preservation Order; and (d) the right to subdivide land. Schedule 1 sets out the forms to be used in respect of the various applications, decisions, requirements and other matters to facilitate the administration of the Ordinance.

These Regulations specify, in the Schedules, permitted development, i.e. development permitted without the requirement to apply for or obtain a grant of development permission. They shall apply to all land in the Islands except, among other things: (a) undeveloped Crown land, other than undeveloped Crown land in respect of which a lease has been granted; (b) land within a conservation area declared under the Physical Planning Ordinance; and (c) land within any declared area under the National Parks Ordinance.

The provisions of this Decree of the Ministry of Environment apply to all activities which comport a change in the natural environment or the landscape including drilling for oil and industrial activities. As a rule, plans for such activities shall be submitted for approval to Department at least 1 year before they are implemented (sect. 2). The Department may require modification of plans and appoint an inspector (sect. 3). The Department shall supervise activities and prevent pollution of natural resources. In accordance with provisions of section 9 the Department may withdraw approval.

Subsection (2) of section 13 is renewed. It provides for the publication of a permission to carry out development. The new section 15 concerns appeals by persons aggrieved by a permission to carry out development. Objections may be lodged with the planning authority. Appeal against the decisions of the authority may be had with the British Resident.

Land Development Duty Regulations.

These Regulations implement provisions of the Land Development and Utilization Act and concern, among other things: registration on the register as mentioned in section 2 of the Act; appeal against an Order made under subsection (1) of section 5 of the Act; information to be provided to the Minister on any sale of agricultural land or to any grant, assignment or surrender of a tenancy of such land for an interest not less than that of a tenancy for a year; and representations to the Land Development and Utilization Commission.

Resolution No. 302 of 1988 redefining requirements and conditions for obtaining licences for the division of lands destined to construction or reconstruction.

This Resolution is composed of 9 articles. Article 1 decrees the ban on the division of lands intended to the construction or reconstruction before obtaining licences from the Ministry of Housing. Article 2 specifies documents and certificates necessary for submitting applications to the department of Physical Training. Article 3 classifies lands subjected to the division in tree categories: lands situated in zones with accredited and adopted detail planes; lands situated in zones with general planes; and, lands situated outside of planned zones. Article 5 defines obligations of licensees.

Resolution of the Council of Ministers issuing the Regulation of the Objection Committee for the expropriation of lands for public utilities and purposes provided for in Law No. 33 of 1964.

This Resolution is composed of 42 articles. Articles 1 to 3 deal with the establishment and management of the Objection Committee. Articles 4 to 6 entrust the Committee to make decision and render judgment in controversies concerning proprieties, areas and boundaries of expropriated lands, as well as to value compensations. Articles 7 to 34 provide for procedures and measures for objections. Articles 35 to 42 pertain to steps and procedures for decisions of the Committee.
