Ministerial Decree No. 715 validating the Regulation on land-use planning and the modalities of carrying out thereof.

This Ministerial Decree establishes the modalities and contents of land-use planning and shall have as is priority issue land-use planning at the national level. The purpose of land-use planning shall be to ensure enforcement of land legislation and observance thereof by all natural and legal persons irrespectively of the form of ownership and land tenure.

These Regulations implement provisions of the Survey Act with respect to the Land Surveyors Board, the Standing Committee on Geographical Names, the examination and issue of licences, land survey operations, government land surveys and resolution of disputes. The Regulations also provide for the reservation of land in case of survey for purposes of alienation of government land in coastal areas and near to lakes or tidal rivers.

Le susdit arrêté porte la réglementation relative à l’exécution de l'article 37, alinéa 2, de la loi du 29 mars 1962 organique de l'aménagement du territoire et de l'urbanisme. Ce dernier article a trait à l’indemnité à charge, suivant le cas, de l'Etat, de l'association intercommunale ou de la commune lorsque l'interdiction de bâtir ou de lotir résultant d'un plan revêtu de la force obligatoire met fin à l'usage auquel un bien est affecté ou normalement destiné. A ce propos l’article 1er de l’arrêté précité établit que les parties peuvent, chacune à ses frais, faire appel.

L’article 1er du susdit règlement établit que le plan d’aménagement global «Haff Réimech», constitué par le plan d’occupation des sols joint en annexe qui fait partie intégrante du présent règlement grand-ducal, est déclaré obligatoire. Ce plan englobe des fonds situés sur le territoire de la commune de Remerschen, section A dite de Wintrange et section C dite de Flur ainsi que sur le territoire de la commune de Wellenstein, section B dite de Bech et section D dite de Schwebsingen. The Government, for the purpose of securing and transfer of the plots of urban land and the plots of land of other settlements on conditions of ownership, possession, lease of natural and legal persons, as well as for the purpose of their registration, taxation and transaction, decrees to validate the Regulation and to recommend the bodies of the local self-government to set up in case of necessity special commissions for the determination of the boundaries of land tenure. The Regulation is aimed at the solution of the following problems: 1).

Order No. 12-W/97 regulating land occupation in Tuna dos Gambos Region.

This Order, composed of eight articles, regulates land occupation in Tuna dos Gambos Region, according to the provisions set by Law No. 21-C/92. In particular, it regulates land concession, and the legalization of occupied lands. Article 4 establishes that the planning of the plots should respect the transhumance corridors used by traditional farmers.

This Resolution, composed of one article and one Annex, approves the National Land Policy. In particular, it identifies the national priorities, and provides a classification of land use for agricultural, industrial and mining purposes. Moreover, it defines an implementation strategy and requires for significant changes in the current basic legislation on land. Particular attention is devoted to the institution of a national land cadastre, as well as on tourism development and public works and infrastructures.
