Land Planning and Development (Plans) Ordinance, 2007.

This Ordinance, made under the Land Planning and Development (Guernsey) Law, 2005, implements provisions of the Act in respect of development plans, subject plans and local planning briefs and related environment impact assessments. The Ordinance sets out various procedural requirements for the adoption of plans, including certification of consistency with Strategic Land Use Plan, and defines content requirements for proposals for the designation of a conservation area.

This Decree establishes the modalities of land-use planning in urban areas. It includes also afforestation in urban areas. Land-use planning in urban areas shall be exclusive competence of the local self-government that must ensure organization and implementation of land-use planning in accordance with sanitary norms and regulations. Land-use planning includes creation of green areas, amenity forests and protection forests in urban areas. Deployment of waterworks and urban irrigation systems shall be integral part of land-use planning activity.

This Order, made under section 31 of the Land Act, provides that on the land described in the First Schedule no control person shall, without the prior consent of the Minister or his or her authorized representative: (a) make any new garden; (b) plant any tree or shrub; (c) erect any building of any description whatsoever. The Order also provides for powers of authorized officers in proceedings under section 36 (1) of the Act against any person who has trespassed or encroached upon public land or is in unlawful use or occupation of such land.

Protected Places Order, 2012.

This Order establishes the declaration of protected place. It specifies the place in the first column of the Schedule, more particularly described in the plan specified in the second column deposited in the office of the Surveyor-General, is hereby declared to be a protected place for the purposes of the Act. The Schedule specifies protected areas, Plan number and competent Authority.

This Order amends the Town and Country Planning (General Permitted Development) Order 1995 in Part 40 of Schedule 2 in relation to England only. The amendments concern installation of Part 40 of Schedule 2 installation of certain microgeneration equipment on a dwellinghouse or within its curtilage or, in some cases, blocks of flats.

This Resolution, consisting of 5 articles, establishes the Regional Territorial Planning Scheme of the São Vicente island (EROT-SV). It also states that the General Direction for Territorial and Urban Land Use Planning (DGOTDU) will be responsible for promoting the design of the EROT, through a competition for selecting an enterprise or cabinet with technical capacities. These Regulations designate a coastal area as a Special Protection Area in accordance with Article 4 of Directive 2009/147/EC of the European Parliament and of the Council on the Conservation of Wild Birds. The purpose is to ensure protection from disturbance, capture and damage to nests and eggs under Article 5 of the Directive for all species of birds, not just the birds listed on Schedule 3 (with the exception of those birds covered under Articles 7 for hunting and 9, where derogations are listed).
