Le présent arrêté définit les règles de construction et d’exploitation des stations service qui doivent être appliquées dans la profession pétrolière.En application des termes du présent règlement, nul ne peut, à l’intérieur du territoire Malgache, ni construire, ni aménager une station-service, ni installer des postes de distribution d’hydrocarbures sans une autorisation délivrée par l’Office Malgache des Hydrocarbures (O.M.H).

The purpose of this Regulation is to provide measures to prevent the risk of contamination from hazardous substances in the soil, at sea and in watercourses, as well as air pollution caused by noise and emissions of hazardous substances by implementing regular inspections with the aim to ensure that environmental quality and standards are maintained.

This Decree establishes the modalities of revenue (reimbursement) of excise tax to the producers of agricultural commodities for diesel oil used for agricultural land cultivation. The aforesaid excise tax shall be reimbursed to the following categories of producers of agricultural commodities: (a) owners of permanent tenants of agricultural land without lease contract; and (b) tenants of agricultural land in accordance with lease contract.

The present Regulations provide for the enactment of the Forest Resources Management Act. In particular, the Regulations lay down provisions relating to Crown resource land referred to in :a) The Forest Resources Management Act; b) The Provincial Lands Act; c) The Natural Resources Act. A licensee within the meaning of the Forest Resources Management Act shall obtain a resource land disposition to use or occupy Crown resource land for the purposes of a processing facility, camp, mill site, timber storage area, quarry, or sand and gravel pit.

Petroleum Development Road Regulation (B.C. Reg. 356/98).

The present Regulation enacts section 133(2) of the Petroleum and Natural Gas Act. In particular, the Regulation lays down provisions relating to petroleum development roads, which means a road constructed over Crown lands reserved for the construction and operation of a road, or operation of a road to facilitate exploration for, and the winning, extraction and removal of petroleum and natural gas, and includes any extensions of such a road over land other than Crown land provided for in the application or subsequently authorized by the commission.

Guidelines for the calculation of damage caused to atmosphere, land and water resources by oil pollution.

These Guidelines establish the modalities of the calculation of damage caused to atmosphere, land and water resources by chemicals, regulate calculation of payment for the compensation of damage caused to land by oil pollution and shall be applicable to all land categories. The Guidelines shall be applicable to dispute settlement regarding environmental offences and shall be used by the authorized environmental institutions and nature managers carrying out oil transactions. Damages shall be intended losses related to the mitigation of the consequences of environmental pollution.

Decree relative to measures to counteract pollution from underground oil tanks.

A Decree of the Department of the Environment to protect the environment from pollution from tanks for the storage of oil which are lying underground. The provisions of the Decree deal, inter alia, with: quality of tanks (sect. 4); control of tanks in general (sect. 5); periodical controls (sect. 6); automatic leakage control of tanks with double walls (sect. 7); notification of tanks to municipalities (sect. 9); supervisions and registration (sect. 10).

Decree on combating oil pollution on land (No. 977 of 1974).

Decree to implement provisions of the Act on combating oil pollution on land of 1974. It prescribes measures to prevent or combat oil pollution caused by the storage of oil. Specific duties are laid on the party storing oil for safe storage and to prepare a contingency plan if more than one million liters of oil is stored at the same site. The contingency plan shall contain the information specified in article 5. The contingency plan shall be approved by the local council and be ratified by the Regional water and Environment District (art. 6).

This Regulation makes provision to reduce and prevent pollution of the outer environment, which is defined as being all land, water, and air, outdoors, and outside workplaces. The Regulation shall not cover those activities and enterprises which are already subject to the laws referred to in article 1. Chapter 3 deals with inspection and control. The Local Environmental Health Commission shall oversee the implementation of this Regulation (art. 3.1). The supervision shall encompass air, land and water, as well as all equipment and all circumstances which might cause pollution.

Decreto Nº 1.942 - Reservas y adjudicación de terrenos baldíos.

El presente Decreto dispone que podrán declararse por parte de la Junta Directiva del Instituto Colombiano de la Reforma Agraria, como reservas territoriales especiales del Estado, los terrenos baldíos situados en zonas aledañas o adyacentes a las exploraciones y explotaciones petroleras o mineras, los cuales en consecuencia, no podrán ser adjudicados a ningún título a los particulares. Tales tierras baldías sólo podrán reservarse en favor de las entidades de derecho público cuyo objeto esté directamente relacionado con las actividades de exploración y explotación petrolera o minera.
