These Regulations amend the Foreshore Act 1933 for the purpose of giving effect in part to Council Directive No. 2011/92/EU. They amend section 13A which sets out the developments/activities that may require environmental impact assessment in relation to consents under the Act. Deep drilling within the scope of the Annex to the Directive. The Regulations also prevent double screening of environmental impact assessment in respect of a petroleum activity where a foreshore lease or licence is being sought.

The present Regulations enforce the Federal Real Property and Federal Immovables Act (S.C. 1991, c. 50). In particular, the Regulations lay down provisions relating to the leasing of oil and gas rights located on certain public lands. Section 3 establishes that subject to these Regulations, the Minister may, by way of lease, grant to any person the exclusive right to search for and take oil and gas within and under lands in the Provinces of British Columbia, Alberta, Saskatchewan, Manitoba, Ontario and Quebec. The text consists of 3 sections.

The present Regulations enforce the Territorial Lands Act (R.S. 1985, c. T-7) and the Federal Real Property and Federal Immovable Act (S.C. 1991, c. 50). In particular the Regulations lays down provisions relating to the administration and disposition of oil and gas belonging to Her Majesty in right of Canada under all lands forming part of Canada but not within any province. Section 3 establishes that these Regulations apply only to Canada lands that are under the control, management and administration of the Minister.

These Regulations amend the Planning (Hazardous Substances) Regulations (Northern Ireland) 1993 to implement Article 30 of Directive 2012/18/EU of the European Parliament and of the Council on the control of major-accident hazards involving dangerous substances, which amends Council Directive 96/82/EC on the control of major-accident hazards involving dangerous substances. They insert “heavy fuel oils” to the list of hazardous substances and controlled quantities in Schedule 1 and concern exceptions for existing hazardous substances consents.

The present Regulations are made under section 90 of the Petroleum Resources Act. In particular, the Regulations lay down provisions relating to the administration and registration of interests and instruments in relation to lands and fees to be paid. Section 2 establishes that the Registrar shall supervise the operation of the system of registration established under Part 8 of the afore-mentioned Act.

The present Regulations are made under section 66 of the Petroleum Resources Act. In particular, the Regulations lay down provisions relating to the levying of royalties for oil exploitations. The text – consisting of 23 sections – deals with the following aspects: interpretation, prescribed royalties, exemption, payment of prescribed royalty, deferral of royalty, certification of an abandonment and restoration royalty trust, return allowance, certification of qualified petroleum exploration expenses, reports and returns, interests, penalties and refunds.

These Regulations give further effect in Irish law to Article 3 of Directive No. 2011/92/EU of the European Parliament and of the Council on the assessment of the effects of certain public and private projects on the environment, They amend Part 2 of Schedule 5 of the Planning and Development Regulations 2001 to include all deep drilling within the scope of the Annex to the Directive. This Schedule sets out the developments/activities that may require environmental impact assessment in relation to consents under the Planning and Development Act 2000.

These Regulations amend regulation 2 of the Control of Major Accident Hazards Regulations (Northern Ireland) 2000 so as to give effect to Article 30 of Directive 2012/18/EU of the European Parliament and of the Council on the control of major accident hazards involving dangerous substances. Article 30 concerns classification of heavy fuel oils. Establishments where heavy fuel oils are present in a specified quantity become subject to the principal and, in certain cases, to additional requirements as set out in regulation 3(1) of those Regulations

This Regulation prescribes the necessary methods, in terms of technical rules and requirements, cadastre and survey issues, all regarding the underground and surface pipelines, used for the following: water supply/flow; sewerage and waste waters; thermal waters flow; electro-energy transmission; telecommunications; oil supply/transit/flow; gas supply/transit/flow; and common water sector facilities (on the territory of the Republic of Srpska, autonomous district of the Federation of Bosnia and Herzegovina).The Annex is an integral part of this Regulation.
