This Regional Law regulates the procedure of registration of citizens with three and more dependent children that want to purchase in ownership free of charge plots of land pertaining to public or municipal property for housing construction. Documents required for access to this program are listed in this Regional Law.

This Regional Law regulates relations dealing with land tenure, protection and conservation of land, establishing plenary powers of regional state bodies in this sphere. It establishes minimum and maximum (150 ha) public and municipal land areas for plots of land allotted for family farming, and minimum (0, 5 ha) of agricultural land plots allotted in ownership for family farming. Single natural or legal persons cannot have in ownership more than 10 percent of the whole available agricultural land area on the regional territory.

This Regional Law regulates relations dealing with land tenure, protection and conservation of land, establishing plenary powers of regional state bodies in this sphere. It establishes minimum (equal to minimum land area authorized for construction in accordance with land-use planning provisions) and maximum (up to 1,500 square meters) public and municipal land areas for plots of land allotted to families for housing construction. It envisages allotment of public agricultural land to citizens with three and more dependent children for family farming and/or subsistence farming.

Article 9.1 establishes minimum and maximum land plot area dimensions allotted free of charge to citizens in ownership for individual housing construction, subsidiary small holding and family farming.

Article 8.1 shall be amended to add the following wording: “Regional Government shall exercise the following plenary powers: (a) governance of regional public land; (b) allotment of land plots pertaining to regional property free of charge in ownership or in open-ended hereditary possession or tenancy; (c) land valuation for the purpose of conclusion of purchase and sale contracts; (d) establishment of land lease fees; (e) establishment of servitude fees and establishment of public servitude; and (f) validation of average cadastre value of land”.

This Regional Law regulates land relations within the limits of plenary powers transferred to regions by the Russian Federation.

The scope of this Regional Law shall be to perform legal regulation of the issues related to ownership, tenancy and governance of land, including agricultural land, land shares in common ownership, and also relations concerning land reservation and land expropriation.

This Regional Law regulates the allotment, free of charge, of public land plots with delimited ownership and pertaining to the regional or municipal public land stock in ownership to some categories of citizens. The following categories of citizens shall have the right of allotment free of charge of public land in ownership: (a) multi-child families; (b) single-parent families with dependent children of minority age; (c) orphans upon reaching the age of 25 years thereby; and (d) families awarded with the Order “Parental glory”.

This Regional Law establishes that the prices of plots of urban land destined for agricultural production in ownership by agricultural organizations or peasant farms allotted thereto on condition of permanent (open-ended) land tenure or as life-long hereditary possession shall be established with 15 percent reduction in relation to its cadastre value.

Article 1 shall be amended to add the following wording: “Transfer of agricultural land in ownership shall be performed in accordance with land purchase and sale contract”.

Article 5 shall be amended to add the following wording: “Decision on allotment of a plot of land free of charge in ownership to citizens must specify cadastre number, location, land area and authorized land tenure”.

Amends: Regional Law No. 74-ZKO “On allotment of land in ownership free of charge to some categories of citizens”. (2011-09-21)

Article 16 shall be amended to add the following wording: «State registration of rights shall be performed in accordance with the request of legal holder of rights, parties to a contract, or authorized person thereby in the presence of notarially certified power of attorney, if not otherwise envisaged by the law, and also at request of judicial bailiff-executor».
