This Chapter contains rules relative to the allocation of agricultural leases. The Chapter, among other things: concerns applications for a lease; prescribes criteria for the assessment of an application; prescribes the form of a lease; and require the Department of Agriculture to process applications and to determine the best agricultural use for land subject to lease. The Department shall also make periodic inspections of leased land.

This Ministerial Decree regulates keeping of the Register of peasant farms and the modalities of registration thereof. The Register shall be public and it shall contain data related to the establishment re-organization. The scope of the Register shall be to collect and store data and information related to the functioning of peasant farms. The Register shall be kept in the official language but its contents can be translated in other languages. Data regarding land area must be recorded up to a hundredth of hectare.

These Regulations implement the Crown Lands Act by further making provision for leases of crown lands and licences for activities to be carried on such lands. Provisions of Part 2 define which lands are available for leases, regulate commencement, execution, and surrender of leases and payment for improvements on land. Various provisions of Part 3 are concerned with licences for grazing of livestock, occupation licences and licences for miscellaneous nature. "Occupation licence" means a licence under section 90 of the Act.

This Decree provides for the determination of land prices, assorted-land price brackets and valuation of specific land categories. It shall be used as a basis for calculating land use levies and determining land use right values as from articles 33, 34, 35, 40 and 50 of the Land Law No. 13/2003/QH11. The Decree consists of 17 articles divided into 4 Chapters as follows: General provisions (I); Methods of determining land prices and assorted-land price brackets (II); Determination of prices of various land categories in localities (III); Implementation organization (IV).

This Decree establishes the modalities of revenue (reimbursement) of excise tax to the producers of agricultural commodities for diesel oil used for agricultural land cultivation. The aforesaid excise tax shall be reimbursed to the following categories of producers of agricultural commodities: (a) owners of permanent tenants of agricultural land without lease contract; and (b) tenants of agricultural land in accordance with lease contract.

A person who receives a notice for a claim for collective enfranchisement made under Part I of the Leasehold Reform Housing and Urban Development Act 1993 must respond by giving a counter-notice admitting or opposing the claim. These Regulations prescribe a requirement, in addition to those specified in section 21 of the Act, as regards the contents of the counter-notice.

These Regulations amend the Leasehold Reform (Notices) Regulations 1997 and provide new forms of notices to be used by tenants applying for enfranchisement and extension of long leaseholds under the Leasehold Reform Act 1967. The new forms are to be used for applications made on or after a specified date. Forms which are substantially to the same effect as those prescribed may also be used.

This Decree establishes calculation and payment of land charges by legal persons. Land charges shall be compulsory for all land tenants, including lessees and landowners except for cases envisaged by the national legislation. Land charges shall be collected in the form of land tax or rent for land plots allotted on lease to local self-government. The amount of land tax shall be set in accordance with quality and location of land plot and it shall not depend upon economic and other activities by land tenants and landowners.

The present Regulations provide for the enactment of the Forest Resources Management Act. In particular, the Regulations lay down provisions relating to Crown resource land referred to in :a) The Forest Resources Management Act; b) The Provincial Lands Act; c) The Natural Resources Act. A licensee within the meaning of the Forest Resources Management Act shall obtain a resource land disposition to use or occupy Crown resource land for the purposes of a processing facility, camp, mill site, timber storage area, quarry, or sand and gravel pit.

These Regulations provide various forms for purposes of the Land Act and Regulations made thereunder. They may, with approval of the Commissioner, Registrar or other authorized officer be modified, adopted, altered according to the circumstances. Forms are divided into 7 groups: Management and Administration (A); Granted right of occupation (B); Mortgage (C); Leases (D); Easements (E); Co-occupancy (F); Miscellaneous (G).

The Regulation is composed of 9 sections, i.e. Name of Regulation (1); Commencement (2); Definition (3); Notes (4); Awards (5); Remuneration of arbitrators and members of arbitration committees (6); Application of Commercial Arbitration Act 1984 (7); Repeal (8) and Savings and transitional provisions (9).
