These Regulations, consisting of 11 sections completed by one Schedule, prescribe forms for purposes of Real Property Act. Furthermore provision is made for the sale of real property pursuant to a statutory charge and the attestation of execution of instruments by individuals. The Schedule contains a table of forms including forms relative to variation of priority, grant of easement, transfer of land, grant of right of way, lease, sub-lease, caveat compulsory acquisition, application to amend survey, sale pursuant statutory charge.

This Implementing Regulation explains and specifies provisions of Legislative Decree No. 3 of 1994 concerning land and environment planning. The Implementing Regulation is composed of 4 Sections divided into 59 articles. Section 1 deals with terms and definitions. Section 2 specifies the objectives of this Regulation as well as the basis and standards for the division of lands. Section 3 refers to procedures adopted for the division of lands. Section 4 deals with the following matters: (a) projecting provisions; (b) complaint affairs; (c) fees; and (d) offences and penalties.

Decision No. 179998/QD-BTC of the Minister of Finance to issue the Regulation on the land, water surface and sea surface rents applicable to foreign investment forms in Vietnam.

This Decision of the Minister of Finance provides for issuing the Regulation on rents applicable to foreign investors who rent land, or water expanses or sea areas in order to conduct their operations (agricultural, infrastructure etc. etc.) Rent Coefficients shall be calculated for urban, non urban land, water( meaning river and lakes) and sea on specific parameters.

Directive No. 245-TTg on urgent work to be done concerning the management and use of land by those local organizations which have been allocated land by or have leased land from the State.

The Directive aims at preventing illegal expropriation, misuse or abuse of land and mismanagement of land rent, by ordering and providing for an inventory of all organizations and individuals that have been assigned land by the State or are directly managing and using land; those same organizations or individuals are compelled to provide the competent Authorities with the total land area measurements, the use they are doing of that land and to comply with land lease payment.

Ministerial Decree No. 926 validating the Regulation on concession on lease of the plots of land, natural objects, constructions and edifices on the territory of national parks for regulated tourism and recreation.

This Ministerial Decree establishes that the plots of land, natural objects, constructions and edifices on the territory of national parks for regulated tourism and recreation shall be conceded on lease to the holder of licence covering the aforesaid activities issued by administration of the national park. The period of lease shall be up to 50 years. Concession on lease of the plots of land and natural objects shall be carried out through tenders. Contract of lease shall be signed by the director of national park and licence holder.

Governmental Decree No. 187 “On establishing executive bodies of local government (village authority).

This Governmental Decree stipulates that village authority shall be the authorized state institution competent in the following spheres: (a) setting up special land fund of the local community; (b) organization and conducting of auctions for concession of land lease to natural and legal persons; (c) supervision over water supply, water distribution and rational water use; and (d) enforcement of legislation of land and natural resources management.

Ministerial Decree No. 108 of 2000 regarding the validation of the Regulation on the modalities of concession of subsoil in lease.

The Government decrees to validate the Regulation. The document consists of X Sections that contain 40 Articles. Section I establishes the rules of concession of subsoil in use. Section II specifies the modes of concession. Section III regards the concession through direct negotiations. Section IV regards the organization of investment programs tender for the concession of subsoil in lease for either prospecting or extraction, or combined prospecting and extraction. Section V deals with the modalities of tender offer. Section VI summing up of tender and making known the winner.

These Instructions establish the modalities of the registration of the contracts of granting of the share of land on lease. The contract of lease can be concluded by the owner of the share of land (Landlord), and an agricultural enterprise or a farmer (Lease-holder). Either a single landlord or a group of landlords can grant on lease shares of land. In the latter case the contract of lease is concluded with multitude of physical persons on the part of landlords.

Lands marked out and defined under subsection (1) of section 19 must be: (a) declared by the Minister by Notice in the Gazette to be vacant lands under the control of the Board; and (b) dealt with in all respects as native lands. Income arising from vacant lands vested in the Board under this section, must be paid to the Central Fijian Treasury and used exclusively for the benefit of Fijians in a manner and for purposes approved by the Minister on the advice of the Great Council of Chiefs.

The procedure for the implementation of the state registration of rights of possession, use, lease and ownership to the land plots, as well as servitudes and other restrictions of these rights, are stated in the present Directions. The present Directions are designed for Goskomsev land resources services of districts, as well as for Uzgeodescadastre state real estate cadastral services of districts and towns which are commissioned to implement the official registration of the rights to the land plots.
