Land Utilization and Settlement Rules, 1962 (Cap. 318).

These Rules, made under the Agriculture Act, concern land settlement and land allotment. The Land Development and Settlement Board shall administer: (a) the Tenant Farming Scheme; and (b) the Assisted Ownership Scheme. An application for participation in an approved settlement scheme shall be made in the form specified in the First Schedule to these Rules. Applicants shall meet certain requirements to be able to participate in a scheme. As for the Tenant Farming Scheme, the Board may allot land and grant leases to tenant farmers selected by the Board in accordance with these Rules.

Flexible Tenancies (Review Procedures) Regulations 2012 (S.I. No. 695 of 2012).

These Regulations make provision with respect to the procedure to be followed in conducting a review of a flexible tenancy. Such tenancy may be offered by the landlord to a prospective tenant. They also provide with respect to reviews upon application of a tenant following a decisions of the landlord not to grant another tenancy on the coming to an end of a flexible tenancy.

These Regulations, for purposes of section 4 of the Africans on Private Estates Act, prescribe forms for: the register of resident Africans; the document certifying registration; and the register of Africans entering an estate under special agreements. The Regulations also specify particulars that shall be included in the registers.

These Regulations amend the Land (Duties and Taxes) Act in the Second Schedule by adding at the end of the Schedule a note on the definition of the date of transfers of specified transactions of purchase, including transfer by a lessee who is the holder of a new lease pursuant to section 6(1E) of the State Lands Act or section 10(3B) of the Pas Géométriques Act. Schedule 2 specifies rates for purposes of section 4(4) of the principal Act.

This Act makes provision for the management, development and protection of the forest resources of The Bahamas and for related matters.The Act consist of 36 sections divided into 9 Parts: Preliminary (I); Administration (II); Forest Reserves, Protected Forests and Conservation Forests (III); Protected Trees (IV); Leases, Licences and Permits (V); Forestry on Private Land (VI); Power of Officers (VII); Offences (VIII); Regulations (IX).The Act provides for the establisment of an agency in Government to be called the Forestry Unit.

Article 8 shall be amended to add the following wording: “Public land plots shall be allotted to citizens and legal persons for purposes non-related to construction in ownership, permanent (open-ended) tenancy, tenancy for a determined period free of charge or in lease in accordance with the acting legislation”.

Perpetuities and Accumulations Act 1989.

This Act modifies the law relating to the avoidance of future interests in property on grounds of remoteness and governing accumulations of income from property. The rule against perpetuities shall not apply to an option to acquire for valuable consideration an interest on the term of a lease if: (a) the option is exercisable only by the lessee or his or her successors in title, and (b) it ceases to be exercisable at or before the expiration of one year following the determination of the lease.

This Act makes provision for the registration of title in land and defines effects of registration of title. The Act also provides other rules relative to dealings in land. Land in respect of which title has been registered under this Act may not be transferred, mortgaged, leased or otherwise dealt with, and an instrument that purports to deal with such land shall not be registered, except in accordance with this Act. Rights in land shall be registered with the Registrar of Titles of Norfolk Island.

This Act provides rules relative to lease of Crown lands, i.e. Crown land of the Commonwealth in respect of which the Administrator is authorized by the Minister to make grants or other dispositions, and deal with in accordance with this Act, on behalf of the Minister. The Administrator may grant a lease of unleased Crown land to an applicant for a lease.

Conveyancing Act 1913.

This Act provides rules relative to the conveyancing of land and relevant registration of transactions by the Registrar of Lands, who is appointed under this Act by the Minister. No land shall be sold, mortgaged, or leased (except for a period less than one year), or otherwise dealt with or disposed of except in accordance with this Act. The Act sets out the procedure of registration and defines duties of the Registrar.

Land Tenants (Security of Tenure) (Amendment) Act, 2010 (Act No. 10 of 2010).

This Act amends the Land Tenants (Security of Tenure) Act in section 4(3) by deleting the words “at least six months” and substituting the words “on or”. Section 4(2) provides that a statutory lease shall be a lease for thirty years commencing from the appointed day and, subject to subsection (3), renewable by the tenant for a further period of thirty years.
