Alienated Lands Act (Cap. 145).

This Act makes provision for the registration of alienators having the right to negotiate negotiation of alienation of land of custom owners and the registration of mortgages on alienated land. Furthermore the Act provides for various matters relative to negotiation of land and consequences of alienation. Notwithstanding the provisions of the Land Reform Act, Cap. 123, the Minister shall cause a register of alienators to be kept (sect. 2) and if the Minister is satisfied that an applicant under section 3 is an alienator he shall register him as such in the Register.

The President decrees that allotment on lease or in ownership shall be performed exclusively out of stock of public land (excluded agricultural land) with broad public participation and with the participation of Public council under the President of Chechen Republic and Councils of elders of inhabited localities. Plots of land shall be put on auction sale for purchase of the right of lease and the right of ownership.

This Act places restrictions on the creation of settlements, trusts and future interests in relation to rights in land and other property.Subject to certain exceptions, the Act prohibits the settlement of property, the limitation of any property in trust for another or any vesting in possession of property at a future date. Exceptions concern, among other things, tenancy for life and tenancy in common. The Act also defines the effects of any dispositions made contrary to this Act.

Article 2 of the above/mentioned Act establishes that the lessor shall notify the conclusion of a lease contract without delay to to competent authority, as well as of any modification of such a contract.

There shall be maintained in Port Vila a Land Records Office in which shall be kept a register to be known as the Land Leases Register. A Director of Land Records shall be appointed under section 3. The Director shall prepare a survey plan for each parcel of land in accordance with section 10. Effects of registration are defined in section 14 and following. Section 27 defines the priority of registered instruments. Subject to the provisions of this Act (sections 32 to 50) and of any other law, the owner of land may lease the land or part of it to any person for a definite term.

La presente Ley introduce el marco normativo relativo a los procedimientos de adjudicación para compraventa o usufructo de bienes inmuebles propiedad del Estado o de otras entidades públicas, con fines habitacionales a favor de las familias en situación de pobreza que los ocupen. La Ley indica las distintas autoridades competentes para gestionar los procedimientos de adjudicación, según se trate de inmuebles del Estado, de las municipalidades o de otras entidades públicas.

This Regional Law establishes price of agricultural land pertaining to public or municipal property, minimum lease period thereof, and procedure of conciliation on location of agricultural land plots allotted as land share in common land property. Minimum lease period for arable land, hayfield, pasture and other categories of agricultural land shall be 3 years.

This Regional Law establishes that minimum land area of newly consolidated agricultural land, including reclaimed land, allotted on condition of ownership or lease shall be 5 ha. Maximum land area of agricultural land that can be allotted or purchased by a single citizen and (or) a single legal person shall be determined in accordance with the type of agricultural activity and specified in the Annex to this Regional Law.

This Act amends the land Act, 1999 and Courts (Land Disputes Settlements) Act, 2002. The Land Act 1999 is amended in provisions concerning the jurisdiction of the District Land and Housing Tribunal and the District Court (sect. 50), exemption of leased land or any class of leased land from application of provisions of Part IX of the principal Act (sect. 77), determination of the amount of rent for leased land (sect. 78), and disputes regarding leases and termination of lease (sects.
