The present Law shall supplement Article 110 of the Land Code of Ukraine with a new part 3. According to this new part, division or consolidation of land plots shall not terminate the validity of limitations, encumbrances established for land plots, except for the instances when such a limitation (encumbrance) applied only to a part of a land plot which, as a result of dividing the relevant land plot, has not become a part of the new land plot formed. Article 125 of the Land Code of Ukraine shall be rendered in a new wording. According to this new wording, the ownership right for a land plot, as well as the right for permanent use and the right for lease of a land plot shall emerge from the moment of state registration of such rights. Article 126 of the Land Code of Ukraine shall also be rendered in a new wording. According to this new wording, the ownership right for a land plot shall be certified by the state act. In addition, it shall be envisaged that the ownership right for a land plot acquired into ownership from lands that are in private property without changing its borders and its targeted designation shall be certified: (a) by a civil and legal agreement related to the alienation of a land plot that was concluded according to the procedure specified by the law in the instance of acquiring the right of ownership for a land plot under such an agreement; and (b) by the certificate for the right for inheritance. By way of introducing amendments to Article 56 of the Law of Ukraine “On Land Management”, it shall be established that, at the time of diving or consolidating land plots, technical documentation on land management related to executing documents that shall certify the right of ownership for a land plot shall include: (a) an explanatory note; (b) copies of documents that shall certify the right of ownership for land plots; (c) plans of land plots that shall be consolidated into one land plot or a plan of a part of the relevant land plot that shall be admeasured as a separate land plot; (d) materials of field land measuring works; and (e) the deed on acceptance and conveyance of land-marks for their storage at the time of dividing a land plot along the dividing border.
