Ce décret du 1887 porte obligation de respecter les servitudes existants sur les terres que les propriétaires veulent clôturer. Les propriétés non clôturées doivent être délimitées par un bornage apparent.
En vertu de ce décret du 1886, les droits privés déjà existants ou qui sont à acquérir doivent, pour être légalement reconnus, être enregistrés par le conservateur des titres fonciers.

The Minister may dispose of Crown lands by grant, sale, lease or otherwise in such manner and on such conditions as he may deem advisable, and may grant any Crown land in exchange for any other land or interest therein.
